To the first Article of the sayd allegatio … To the first Article of the sayd allegation This deponent saith that in the moneth<br />
of January 1653 last past new stile the widdow and heyres of George<br />
Ettonheard were accounted the lawfull Owners of the arlate eight chests<br />
or Cases of silver conteyning in each of them twenty thousand Rialls<br />
in peices of eight marked as in the margent and beleiveth they<br />
were and now are the Owners thereof, for that att the tyme of lading<br />
the same hereafter sett forth the party who brought the same aboard had<br />
dispatches or Licenses for lading the same in the name of the sayd Claymer<br />
And otherwise cannot depose.
To the second article of the sayd allegation This deponent saith that the moneth<br />
of January 1653 new stile the foresayd eight Chests or Cases of<br />
sylver marked and conteyning as aforesayd were laden aboard the sayd<br />
shipp the ''Morning Starr'' att Cadiz for the accompt and risko of the sayd widdow and heyres<br />
of George de Etton Head to be transported to Dunkirke and there to be<br />
delivered for their accompt to their factors which Chests of sylver<br />
This deponent being master of the sayd shipp receaved aboard for the accompt<br />
aforesayd And otherwise he cannot depose.
To the third article of the sayd allegation This deponent saith That upon the lading<br />
of the sayd Chests of sylver he this deponent did signe severall bills<br />
oflading for the same a shoare att Cadiz to say 3 bills all of one tenor for three of the sayd<br />
Chests and 3 more all of one tenor for two more of the sayyd Chests and<br />
that the three bills of lading of different tenors left in the Registry of<br />
this Court to be shewne to him this Examinat were and are three of the<br />
sayd originall bills of lading and the same are and were signed by this<br />
deponent with his owne name and hand as is now to be seene at the foote<br />
of every of them respectively and the same and reall and were so signed<br />
att Cadizz on or about the dayes of the dates threof respectively And<br />
further referring himselfe to the sayd bills of lading he cannot depose.
To the fourth article of the sayd allegation he saith that the Barkers who brought<br />
the sayd sylver aboard by shewing the foresayd dispatches for the same, and by<br />
factors by whose order the same were laden did upon the lading thereof<br />
declare to this deponent that the sayd cases of sylver wer for the Accompt<br />
aforesayd. And otherwise cannot depose
To the fifth article of the sayd allegation this deponent saith that after the lading and<br />
putting on board of the sayd shipp the ''Morning Starr'' the sayd eight Cases<br />
of sylver the sayd shipp did depart therwith towards Dunkerke and in her<br />
Course thither was mett withall surprized and taken by some of the Parliaments<br />
shipps and by them brought into the River of Thames, And saith that att<br />
the tyme of the sayd surprizall of the sayd shipp all the sayd eight Cases<br />
of sylver were and remained on board the sayd shipp and came into the<br />
possession of the Captaine who made the seizure. All which he knoweth<br />
being master of the sayd shipp and aboard her att the tyme of the sayd<br />
seizure And otherwise cannot depose./
To the sixth article of the sayd allegation This deponent saith that by common<br />
report the foresayd widdow and heyres of George da Etton Heard are<br />
Spaniards, subiects of the King of Spaine, Inhabitants of Madrid<br />
and such as having the management of the Office of Crusado do<br />
furnish the King of Spaine from tyme to tyme with great quantities of<br />
sylver and moneyes for the service of his Armies and affaires in<br />
fflanders, for which service the sylver now in question was [?deXXXX]<br />
as the foresaid factors upon lading the same did declare and otherwise<br />
cannot depose
To the seventh he saith the sayd shipp was bound to Dunkerke and had [?XX]<br />
