were laden and bought and ready provided to be laden before the sixteenth<br />
day of March last, and that the master nor any belonging to the said<br />
shipp had not (soe farr as hee this deponent knoweth) any notice [?hint] or<br />
intelligence either at Virginia or elswhere of the Parliaments forbidding<br />
or declaring against trade with Virginia untill about the eighteenth day<br />
of March last old stile, at which time the said master and company<br />
were taking in their water, provisions and necessaries for their homewards<br />
voyage, and were preparing with all speed for their said retourne, having<br />
before laden and made ready all their goods for the said homewards voyage,<br />
all ehich hee knoweth being boatswaine of the said shipp as aforesaid,<br />
And otherwise hee cannot depose.
To the seaventh and eighth articles hee saith and deposeth that assoone as<br />
the said newes came the master and company made all possible speede to<br />
come away with the said shipp and ladin, and his precontest derrick<br />
Jons[?e]n the sopra caro gave them order soe to doe, and saith that<br />
through hast they came aground with the said shipp un the river as they<br />
were comming downe the river, by meanes whereof and to lighten her<br />
to get her off againe, they were forced to take all her guns, let out<br />
her water and take out many of her provisions, and goods, and doing<br />
whereof and afterwards taking the same againe in againe and in<br />
getting water aboard and in clearing her at James towne they did<br />
unavoidably spend twenty dayes or thereabouts and could not cleare<br />
them selves from the said l[?e]ts and impediments in lesser time<br />
although the master and company did their ut most endeavour to get<br />
cleare thence to come away, All which hee knoweth being boatswaine<br />
of the said shipp as aforesaid and acquainted with the premisses, and<br />
otherwise hee cannot depose.
To the ninenth hee saith that after the said shipp had overcome the said<br />
impediments and was rady to depart, shee was himdered still for<br />
the space of two or three dayes by contrary winde, and then she<br />
came downe the River to Newport Newes where they were againe<br />
constrained to stopp to take in water and fire wood and other necessaries<br />
foure or five dayes, and then being cleare to attend eight or nine<br />
dayes more for the winde, which then s[?erving] her master and company hasted and<br />
came directly away with her prosecuting their course for Middleborowe.<br />
but in such their course they were on or about the 21th of May last<br />
olde stile met with and seized by Captaine Purvis in one of the<br />
Parliaments shipps, and afterwards brought into Yarmouth, which<br />
hee knoweth being aboard her when shee was soe taken. And otherwise<br />
hee cannot depose.
To the last hee saith that the said shipp the ''ffortuna'' did not at<br />
Virginia deliver out or dispose of any victuall, armes or ammunition<br />
or any materialls for Warre of his certaine knowledge. And otherwise<br />
hee cannot depose.

To the first hee referreth himselfe to his foregoeing deposition, and otherwise<br />
answereth negatively.
To the second hee saith that the said shipp the ''ffortuna'' is fflemish or dutch built<br />
and that the said producents as hee hath heard bought her, but of whom<br />
hee knoweth not.
To the third hee saith that the said producents have traded for some<br />
yeares last to Virginia and have formerly received goods thence, and [XX GUTTER]<br />
the goods aboard are not belonging to any in Virginia or elswhere, but<br />
meerly to the said producents, saving a quantitie belonging to the master<br />
and company and some to a younge man of T[?ervier], And otherwise hee<br />
cannot answer saving as aforesaid.
To the fourth hee saith that the said shipp carried tenn guns and noe<br />
more out from Middleborowe to Virginia and brought [?the GUTTER]<br />
