two and twentieth day of March last old stile there came a report or speech that<br />
the parliament of England had prohibited trade and commerce there<br />
and then and not before this deponent had notice<br />
and intelligence of the said newes or report which hee [?meeting] with at James towne, hee sent notice thereof as first as hee could#
[#] to the master who lay with<br />
the shipp in the [XXXX] about 40 English<br />

To the seaventh and eighth articles hee saith and deposeth that assoone<br />
as ever hee this deponent [?marchant] aforesaid of the said shipp heard the<br />
said newes of the Parliaments prohibition of trade there, hee ordered and<br />
withall speede to tale in their necessaries and depart for Middleborowe,<br />
which they accordingly did, [XXXX] all diligence for their dispatch and departure<br />
and in her comming downe the river to depart, through hast and [?insufficiencie]<br />
shee came agroun, whereby her master and company were forced to take out<br />
her guns and let out her water and take out diverse of her goods and<br />
provisions, to lighten her, in the doing whereof and in the taking of<br />
her guns goods and provisions in againe and alsoe in clearing her before at<br />
James towne they spent fifteene dayes or neere<br />
thereabouts, and could not in lesse time cleare her, albeit the<br />
master and company and his deponent used all diligence for her clearing<br />
and dispatch away from the time of such thie getting intelligence of<br />
the said prohibition, The premisses hee knoweth for the reasons aforesaid<br />
And otherwise hee cannot depose.
To the nineth article hee saith and deposeth that assoone as the said<br />
shipp was got cleare of the said impediments,<br />
and that the master and company were [XXXXed] to<br />
set saile to come away, the winde being contrary they were forced<br />
to stay there three dayes to waite for a faire winde to bringe them<br />
downe the river, and then the winde serving they came downe<br />
the River to a place called Newport newes, where they tooke in their<br />
water and other necessaries of wood and other things, about which<br />
they were forced to stay foure or five dayes, and then the winde<br />
not serving, they were foreced there to attend nine dayes or thereabouts<br />
more till the winde came faire and then they set saile homewards<br />
and comming directly for Middleborowe, the said shipp was in her<br />
course met with and with her lading taken and seized by Captaine<br />
Purvis in one of the Parliaments shipps, and brought into Yarmouth<br />
where this deponent left her when hee came for London<br />
about this busines. And otherwise hee cannot depose.
To the last hee saith that the said shipp the ''ffortuna'' dod not at Virginia<br />
deliver out any victualls, armes or ammunition nor any materiall<br />
for warre of his certaine knowledge. And otherwise hee cannot depose.
To the Interrogatories ministed on the behalfe<br />
of the State. [CENTRE HEADING]
To the first hee saith hee hath noe part or share in the said shipp or goods<br />
saving in 18 hogsheads of tobaccoe which are belonging unto him, the restitution<br />
thereof would be advantageous unto him, and hee should have profit by the<br />
restoring of the claimers goods, namely his factor[X]g pay And<br />
otherwise saving his foregoeing deposition hee cannot depose.
To the second hee saith that the said shipp the ''ffortuna'' was and is dutch [?built GUTTER]<br />
and that the said Bassal[?iera] and company are the owners thereof, which<br />
hee knoweth because hee this examinate hath served them therein about<br />
five yeares last past, during which space they have from time to time<br />
sett out and imployed her as sole owners thereof. And otherwise hee<br />
cannot answer.
To the third here saith that the said Baptista and company have [XXX GUTTER]<br />
with the said shipp the ''ffortuna'' to Virginia for the said five yeares or theraboutsnia for the said five yeares or therabouts +
