Examined deposeth as followeth.
On the behalf of the}<br />
said Peterson etcetera}
To the 3d article of the said allegation hee saith and deposeth that hee being<br />
att the Custome house upon the 8th of January last past, the producent [?Christopher]<br />
Peterson came to this deponent and desired him to goe to the arlate Mr Roger kilvert<br />
and to tell him that hee the said producent would not enter any of the said Goods<br />
short, and to desire leave of the said Mr kilvert that hee should enter all or else hee would not enter Att<br />
whose request this deponent saith hee went to the said kilvert, and related the producents<br />
said desires; unto whom the said kilvert made this reply, that hee the said producent<br />
should not enter all, or make a full entrie of the said goods, or words to that effect<br />
And further hee cannot depose
To the fourth article of the said allegation he saith and deposeth that hee this<br />
deponent upon the 9th day of January last past was on board the said<br />
shipp the ''Speranza'', arlate from 9 of the Clocke till 12 att noone or nere<br />
thereupon, att which time the River of Thames was so full of Ice, that the said<br />
producent (being then aboard) was necessitated (to preserve the said shipp and<br />
Goods) to stay on board, and did stay on board, to hale the said shipp ashore<br />
to prevent the Cutting of her cables which might have indangered the said<br />
shipp, And hee saith that [?doe] what he the producent could the said shipp was<br />
not fastned on shoare, att 12 of the clocke when hee this deponent left her<br />
And further he cannot depose, saveing that after 12 of the clocke the Custom[?e]<br />
house is usually shutt upp, and noe Entrie to bee made of Goods or Merchandizes<br />
as is well knowne to Merchants and others who have any thing therein to doe,

allegation he saith and deposeth<br />
that upon the ninth day of<br />
January last past and ymediately<br />
after the returne of the said ship the<br />
''Speranza'' into the River of Thames<br />
from the voyage in question<br />
and before any of her then ladeing<br />
brought in her to this port was<br />
taken out of her[?e] the said<br />
ship was viewed ad<br />
measured by fower dutch<br />
Skippers experienced in<br />
shipping and the vacant Roome<br />
then in her and in which noe<br />
goods were stowed was found<br />
to bee of soe Large apportion<br />
as that if it had bin filled<br />
a hundred Ninety and two<br />
pipes of Canary wines<br />
more than there was then abord<br />
might well and very easily [XX]<br />
have bin stowed therein All<br />
which hee knoweth to e true<br />
because hee this deponent was<br />
with others present when the<br />
sayd shipp was soe [?veiwed] and<br />
measured and sawe the same done<br />
and [XXXX] the said skippers give their<br />
measurements thereupon accprdingly<br />
And further hee cannot depose.<br />

To the 7th article of the said Allegation he saith and deposeth that he this deponent<br />
and other Mercahnts have ordinarily all[?ocated] and [?received] for leakage some[?times]<br />
twelve pipes, tenn, eight, and sometimes sixe pipes [?in ?the] hundred<br />
And further hee saith hee cannot depose./

To the first he saith he very well knoweth the danger of an oath And that<br />
hee cometh to depose in this cause att the request of the producent, And in case<br />
the producent, by this suit, recover his money due, hee saith he is appointed<br />
to remitt the same to his owners beyond seas, and is to receave for the same the<br />
ordinary and accustomed provision, And further hee answareth negatively
To the 2d hee saith hee hath not so deposed/
To the 3 hee he (sic) cannot answare
To the 4th he saith he is a Merchant, and cann both writ and read otherwise negatively
To the 5th hee cannot depose
To the 6th Interrogatorie he saith that he hath heard the producent say that buy the<br />
procurement of the said kilvert, there were [?someof] the Trinity house men aboard<br />
the ''Speranza'' to view her, And hee was by and present when the said producent said<br />
unto the said kilvert that they did ot view the said shipp by his the<br />
said producents procurement but by the order of the said kilvert [?who] also then avowed<br />
the contrary. And otherwise knoweth not
To the 7th hee saith that the producent tould his deponent that the Trinitie house men<br />
said that the said shipp wanted in her freight 130 pipes att her returne the<br />
voyage in question, and otherwise cannot depose, and answareth negatively./
