''Jacob'' did not long before he comeing aground at Dickshore<br />
aforesaid through the unskillfulnes of her Master and for<br />
want of a Pilot rann ashore as is arlate Et aliter<br />
nescit salvis infrascripts.
Ad 5um deponit the shipp the ''Phillip'' arlate att the tyme arlate<br />
was laid up ashore in a convenient place from doeing<br />
or receaving any hurt or damage, and for and as<br />
an emptie ship (as indeed shee was) haveing finished her<br />
voyage. where hee saith shee had soe lyen by the space of<br />
at least three monethes and upwards next before the premisses<br />
redens rationem scientia sua hee this deponent well knoweing<br />
the place where the said ship was soe laid up and the<br />
tyme when shee soe came in thither Et alr nescit deponere
Ad 6 et 7um deponit et dicit that ymediatly before the said ship<br />
the ''Saint Jacob'' arlate was haled and came ashoare at Dickshore<br />
arlate shee did ride att Anchor in the Middle of the channell<br />
of the said River of Thames in a place where this deponent<br />
saith that shipps of more then twice her burden have and<br />
doe now att this instant ride and remaine and have soe usually<br />
done from tyme to tyme in which place if the said ship the<br />
''Saint Jascob'' had continued she might as hee saith without doubt have bin<br />
safe from doeing or receaving and wrong and damage<br />
but hee saith the said ships Company not being content<br />
therewith went to hale her ashoare as is arlate upon the<br />
North side of the saidd River neere unto the shippe the<br />
''Phillip'' arlate att such tyme as the tyde of ebb<br />
was fallen allmost 3 ffoot. The premisses hee<br />
deposeth hee this deponent seeing the same soe had<br />
and done as aforesaid Et alr salvis infrascripts nescit
Ad 8um deponit that this deponent for all the tyme<br />
of his knowledge of the River of Thames as aforesaid<br />
never sawe or heard of any seaman Pilot or Marriner<br />
whatsoever that would as did offer to bring a shipp upp<br />
the said River Laden att an Ebbing tyde on the North side<br />
of the said River, And hee saith it is against the continued<br />
Custome of the said River for any Sea man or Marriner<br />
whatsoever to bring a ship laden to bee haled ashore at<br />
dickshore arlate the said place being an Elboe or corner<br />
of the River and only for empty shippes to be laid upp<br />
in reddens rationem scientia sua ut supra. Et alr nescit<br />
deponere.
Ad 9um deponit et dicit that by the Ordinary use and<br />
Custome of the River of Thames arlate Noe Pilott<br />
or Seaman Whatsoever doeth at any tyme bring any [?shipp] [?XXX]<br />
and endeavour to haile her ashore there, Untill such time as<br />
