IN THE NAME OF GOD AMEN I Thomas Papillon of London Esq:r being of sound and perfect mind and memory God be praised for the same Do make and ordain this my last Will and Testament in manner and forme following

IMPRIMIS I commend my Soul into the hands of Allmighty God my heavenly ffather hoping and assuredly believing to obtain everlasting life by the death and merits of my Lord and Saviour Jesus Christ And my body I commit to the earth to be decently buried without any pomp in the parish church of Acryse in the County of Kent at the discretion of my Executor hereafter named

ITEM I will and appoint that my debts and ffunerall expenses be paid and satisffied in the first place

ITEM I give and devise unto my son Phillip Papillon all those my Lands and Tenements lying and being in Burmarsh in the County of Kent heretofore purchased of S:r William Brodnax Kn:t and alsoe my house and lands later purchased of William Brodnax Esq:r lying and being in Burmarsh ?ffalconherrat and ?Engerswick in Romney Marsh And alsoe all those my Lands and Tenements lying and being in the severall parishes of S:t Maries Bilsington and Hope some or one of them in Romney Marsh in the said County of Kent and late purchased by me of S:r Basill Dixwell Bar:t and alsoe my house and All those my my Lands Messuages and Tenements as well the house and Lands lately bought of my nephew M:r Samuell Papillon as those given me by my ffather lying and being in the County of Leicester To have and to hold all and singular the said Messuages Lands and Tenements lying and being in the said Countyes of Kent and Leicester unto my said Son Phillip Papillon for and during the term of his naturall life And from and after his decease I give and devise the same unto my Grandson David Papillon and to the heirs of his body

And for want of such Issue I devise the same unto the right heirs of my said Son Phillip Papillon forever

ITEM I give and devise unto my said Son Phillip Papillon all that my Messuage or Tenement with the appurtenances scituate in ffenchurchstreete London wherein I now dwell and all my xxxx Estate and interest therein unto my said son Phillipn Papillon his Executors Administrators and Assignes

ITEM I give and devise unto my said Son Phillip Papillon All my household goods and ffurniture of my house in ffenchurch Street aforesaid and all my plate and Jewells

ITEM I do give and devise unto my daughters the Lady Elizabeth Ward the wife of S:r Edward Ward Kn:t Lord Chief Baron of his Maties Court of Exchequer and unto my daughter Anna Maria the wife of William ?Turner Esq:r to each of them the Summe of one thousand pounds of good and lawfull money of England to make up each of their portons the Summe of three thousand pounds equall to what I gave in marriage with my daughter Sarah the wife of Samuell Rawstorne of London Merchant their sister which said money I do hereby will and appoint to be paid to my said daughters the Lady Elizabeth Ward and Anna Maria Turner within six months after my decease and before the payment of any other Legacy or Legacies herein after given or devised And if my said two daughters or either of them shall happen to dye or depart this transitory life before me Then I will and devise the said legacy of one thousand pounds a piece so given and devised unto her or them so dying as aforesaid to such Child or Children as such of my said daughters shall appoint by her or their last Will and Testament And in default of such appointment to be equally divided among the children which shall at the time of her or their deaths be unmarried

ITEM I doe give and bequeath unto my said son S:r Edward Ward and his wife and unto my Son Rawstorne and his wife, and unto my Son Turner and his wife and to each of them the summe of twenty pounds for mourning And I do give to every one of my ?grandchildren living at the time of my death the Summe of ten pounds to be laid out and bestowed by them or their respective parents in ?liewe such thing as they shall like best in remembrance of me

ITEM I do hereby give and bequeath the Summe of one hundred pounds of good and lawfull money of England to be paid to the president and Governours or Treasurer of the hospitall called Christ Hospitall in the City of London for the benefit of the poore Children of the said Hospitall

ITEM I do give and bequeath to the Company of Mercers of the said City of London the Sume of one thousand pounds of good and lawfull money of England And I do hereby recommend unto them that in case it should so fall out in the providence of God that any person or persons lineally descended from me shall hereafter come to be in want that they do afford him her or them such charitable reliefe as they shall in their judgements find convenient

ITEM I doe give unto the poore of the parish of S:t Katherine Coleman London the summe of ffifty pounds of good and lawfull money of England

ITEM I do give and devise unto the poore of the ffrench Congregation or Church scituate in Threadneedlestreet London the Summe of one hundred pounds of good and lawfull money of England to be paid for that purpose into the hands of the Elders or Deacons of the said Church

ITEM I do give and devise unto every one of the Ministers of the aforesaid ffrench Church that shall be

of the said Church at the time of my decease the summe of ffive pounds the like money

ITEM I give to my cousen John ?Showre the summe of ten pounds of good and lawfull money of England to be paid to him by my Executor hereinafter named

ITEM I give and devise unto every of my Servants that shall be living with me at the time of my decease besides their respective wages which my Executor is hereby appointed to pay them the severall Summes following viz:t To Jane Calendrine the Summe of twenty pounds To William Morris the Summe of tenn pouns And to the rest of my Servants Brown the Black excepted the Summe of ffive pouns a piece And to William ?Malyn the Summe of fforty shillings of good and lawfull money of England

ITEM I do give and bequeath the Summe of ten pounds of good and lawfull money of England to be paid unto Ruth Southwick (according to the desire of my late well beloved wife deceased) yearly and every year so long as she shall continue to serve my Executor And if she shall think fit to marry my will is that my Executor do pay her the Summe of ten pounds every year so long as she shall live

ITEM I appoint my Executor in case I be Commissioner of the Victualling at the time of my decease) to present unto each of the then Commissioners of the Victualling a Ring of the value of twenty shillings after the payment of the debts and the Legacies herein given given I do will and appoint that the summe of eight thousand pounds of good and lawfull money of England shall be raised out of my personall Estate and when raised shalll be paid by my Executor hereafter named into the hands of the said S:r Edward Ward Samuell Rawstorne and William Turner or the Survivor of them shall appoint Upon trust nevertheless that the said Summe of eight thousand shall be so soon as conveniently it may be laid out in the purchase of Lands and Tenements in ffee simple of the vallue of four hundred pounds per Ann or as good yearly vallue as can be had for the same which said Lands and Tenements so to be purchased I do will and appoint shall be settled and assured to and upon my said Son Phillip Papillon for his life and from and after his decease to and upon my daughter Susanna the now wife of my said Son Phillip Papillon for her life for her Joynture and in full satisffaction of her Dower or claim by the Custome of the City of London or any part of her said husbands personall Estate accordinge to the Indenture of Covenants made upon their marriage And from and after the deaths of my said Son Phillip Papillon and his said wife Susanna to the use of the first son of my said son Phillip Papillon by his said now wife begotten or to be begotten and the heirs Male of his body And for default of such Issue to the Second Son of my said son Phillip Papillon by the said Susanna his now wife begotten or to be begotten and the heirs male of the body of such second son lawfully issuing And for default of such Issue to the use of all and every other the Son and Sons of the body of the said Phillip Papillon by his said now wife begotten or to be begotten as they shall be in seniority of age and priority of birth and the heirs male of their bodyes respectively the Elder of such Son and Sons and their heirs male of his body lawfully issuing being allwayes preferred and to take place before the younger of such Son and Sons

and the heirs male of his body issuing And for default of such issue to the right heirs of my said son Phillip Papillon for ever And untill such purchase and settlement shall be as aforesaid made I do will and appoint that the said S:r Edward Ward Samuell Rawstorne and William Turner their Executors Administraors and Assignes shall and do permitt and suffer my said son Phillip Papillon during his life and after his death the said Susanna his wife during her life and after their deaths the respective person and persons to whom the next and immediate reverson and the remainder of the ffreehold of the said Lands and Tenements so to be purchased is hereby respectively And successively limitted according to their severall Estates and interests therein to have and receive to his her and their own use and need all the Interest profit and proceed that shall arise and be made of the said summe of eight thousand pounds Provided allwayes and I do hereby will and declare that in case the said eight thousand pounds or any part thereof shall happen to be lost or miscarry either in the keeping thereof in the hands or custody of the said S:r Edward Ward Samuell Rawstorne and William Turner or any of them their or any of their Executors Administrators or Assignes or in the hands or custody of any other person or persons to whom the same shall be paid As that there shall happen any loss in the said purchase so to be made or otherwise howsoever that then such loss or miscarriage shall be borne and sustained by the person or persons to or for whom or whose use or benefit the same did or ought to belong and not by the said S:r Edward Ward Samuell Rawstorne and William Turner or any of them their or any of their heirs Executors or Administrators And alsoe that the said S:r Edward Ward Samuell Rawstorne and William Turner or any of them their or any of their heirs Executors or Administrators shall not be chargeable or accountable the one for the other of them nor for the Receipts xxx or defaults of each other

ITEM whereas I am intitled to one or more Annuity or Annuities yearly rents or payments in the whole amounting to the Summe of one hundred and forty pounds for and during the life of my said Son Phillip Papillon by vertue of one or more act or acts of Parliament made in one or more Session or Sessions held in the fourth and fifth years and in the ffifth and sixth years of the reign of his now Matie and the late Queen Mary And whereas by one other act of Parliament afterwards made such persons whxxever intituled to such Estates for single lives in the said Annuityes were enabled upon payment of such Rate and Rates as are therein menconed to have such Estate for life changed or converted into a certaine xxxxxx for ninety six years to be computed from the ffive and twentieth day of January which was in the year of our Lord1695 or to have receive and enjoy the life Annuity from and after the determinaton of the said Estate for life for and during the residue which should be then to come and unexpired of the said term of ninety six yeares And whereas I have pursuant to the said act of Parliament purchased the reversion of the said Annuity after the death of my said Son Phillip Papillon or changed the said Annuity which I had for his life into the said terme of ninety six years Now I do hereby give and devise the said Annuity or Annuityes yearly rents or payments amounting to one hundred and forty pounds per Anno and all and Every other Annuity Annuityes which I now have or shall have at the time of my decease by vertue of any of the said

Acts of Parliament or any other acts of Parliament made heretofore) unto my said Son Phillip Papillon his Executors and Administrators until my said Grandson David Papillon shall attain to his age of one and twenty years the better to neable him to maintain and educate the said David Papillon

“I doe give and bequeath to my said Son Phillip Papillon a Black person commonly called Brown whom I take to be in the nature and quality of my goods and chattles And I doe require my said Son to endeavour to bring him to the knowledg ofdivine truth And in case he shall learn so as to be able to read and write and give a good account of the principalls of the Christian Protestant religion then to furnish him with the Sume of one hundred pounds to enable him to imploy himself in some lawfull calling with the consent and approbabtion of my said son) or if my said son think good to continue him in his service”

ITEM I give and bequeath unto M:r Robinson (Pastor of the Church Meeting in little S:t Hellens London) the summe of five pounds and the like summe of ffive pounds to M.r Jn:o Lewis Min:r of the parish of Acryse in the County of Kent.
