The depositions were taken on the 28th day of December at the Bull in Rochester.before Richard ?Alson Esquire and Nicholas Tooke Gen:t conducted by virtue of a commission to them and others directed (for the examination of witnesses) out of the High Court of Chancery in a cause there between Willyam ?Rand Gent pl:t and Barnabass Walsall and Thomas Stanley Gents def:ts
Richard Marchan (is this Marchant?) of the Cittie of Rochester victualler aged sixty six yeares or thereabouts was deposed
In answer to the first interogatory he has known both the plaintiff and defendants for twenty years.
In answer to the fourth interogatory the deponent says that he knows "the two messuages or Inns commonly called the Cheq:s and the Crosse Keyes" mentioned in the interogatory and also that he knows the messuage or ?Tent in the interogatory situated in ?Payneters Lane within the city of Rochester where George Towers now dwelleth and that Barnabas Walsalll was "reputed to be the owner of the aforesaid messuages and ?Tents or Inns” and that Walsall bought these messuages and that this deponent has for several years paid Walsall eleven pounds by the year for the Cross Keyes. That the deponent judges the Cheq:s to be worth eighteen pounds by the year. He supposeth that the messuage occupied by George Towers aforesaid is worth forty shillings by the year. He has paid the defendant Thomas Stanley since "the extent of the Statute in the interogatory mencionned" for the rent of the messuage called Crosse Keyes "in money and ?Parliament Taxes sixteene poundes and tenn shillings."
In answer to the ninth interogatory the deponent says he has paid in the last two years twenty pounds "for beere and Ale delivered by the def:t Walsall to this dep:t & that the small beere customers in the interogatory menconned were the Best Paymasters"
To the 10th interogatory the deponent states that he has known that the defendant Walsall for twelve years since December 1634 “hold of the Wardens of Rochester Bridge a stable scituate in the pish of S:t Michaels Rochester & that the value thereof to be lett by the yeare is ffortie shillings w:ch this dep:t himself payeth as Tenn:t thereunto M:r Richard ?Cobby in right of his wife who is daughter to the def:t Walsall and assigned by the said Walsall to the said Cobby upon his marriage with the said wife”
George Powers of the City of Rochester "Labourer aged ffourscore yeares or thereabouts" was deposed
In answer to the fourth interogatory George Powerrs states that he knows all three messuages or Inns and that he lives in the messuage in Payneter Lane and pays to thedefendant Thomas Stanley "ffive poundes for Two yeares Rent & a halfe for the same messuage the last half yeare being due at Michas 1653" Has heard that the Crosse keyes is worth eleven pound by the yeare.
George ?Ongley of Maidstone in the County of Kent gent aged ffiftie & three was deposed
To the first interogatory the deponent states that he lives in a messuage in Maidstone which is reputed to be the defendant Walsalls. And that he has paid Thomas Stanley for two and a half years "in money in (sic) Parliam:t Taxes (sic) after the rate of seaventeene poundes & tenn shillings a yeare for the Two first yeares & for the last halfe yeare ended at Michas 1653 after the rate of 18 :ll a yeare w:ch is in all ffortie & fower pounde & that this dep:t is nowe tena:t at will thereunto"
To the thirteenth interogatory the dept says that he knew the deft Walsall "when he lived at Maidstone & that he lived there well & good esteeme & repute & that about Twentie yeares since in the tyme that he dwelt at Maidstone he did fall into decay & made composicon w:th his Creditors but since hath lived in Good Creditt & esteeme in y:e cittie of Rochester aforesaid where he hath beene twice Major (sic)"
John Waggoner of the city of Rochester blacksmith aged seventy three yeares or thereabouts was deposed
In answer to the fifth interogatory the dept says that he knows the messuage called the “Golden ???Corb scituate in Eastgate streete w:thin the said Citty of Rochester” and also the messuage in the interogatory called "the three dawes" and also "another messuage wherein Willyam ? Nowell nowe dwelleth" "& that he dwelleth in a small Tent late reputed ??pcell of the said Golden ??Corb for w:ch small Tent the said def:t hath paid to the def:t Thomas Stanley one pound two shillings & sixx pence for for three quarters of a yeares rent for the same it being after the rate of one pound es (sic) & tenn shillings a yeare" "of all which messuages & premisses the said def:t Barnabas Walsall was reputed to be owner & that this def:t holdeth the said Tenn:t at will"
To the eighth interogatory he says "he knoweth the capitall Messuage Brewhowse & Bakehowse" mentioned in the interogatory and that he believes them to be "in as good plite & condicion as to the repaires therof when the def:t Thomas Stanley entered thereup as they were at the def:t Barnabas Walsalls first coming thereunto"
To the ninth interogatory he says he cannot add anything about payments on this messauge than he has already said in his answer to the fifth interogatory.
John Baynard of Chatham in the county of Kent yeoman fortie & fower yeares or therabouts
In answer to the sixth interogatory he says he knws "the Messuage & Malthowse formerly a brewhowse" mentioned in the interogatory “and severall pcells of land belonging thereunto in Chatham & Gillingham formerly leased unto the def:t Barnabas Walsall by Maximillyan (sic) Dallison Esq:r” as mentioned in the interogatory. “and that the same are worth or are lett for by the yeare ffowerscore & twoe poundes & eight shillings or thereabouts" "& that this dep:t useth soe much thereof as he payes 72:ll 12:s a yeare for in money & parliam:t Taxes which he hath for 2 yeares and a halfe ended at Michas last paid to the def:t Thomas Stanley & that he beleives the residue of the said yearely rent of 82:ll. 8:s was & hath been paid to the said Thomas Stanley or his assignes"

In answer to the thirteenth inbterogatory the dept says he did not know Walsall when he lived in maidstone "nor any of his proceedings dealings acconns or livelihood during his abode there but hath knowne him almostever since he came to live at Rochester w:ch is 18 yeares since ofr thereabouts & that he & his family hath lived in a plentifull manner & good condicon & that he hath beene twice Major of the citty of Rochester"
Elizabeth Gugley the wife of Henry Gugley of Shorne in the county of Kent husbandman aged 29 yeares was deposed
In answer to the fifth interogatory she says that she knows the messuage "called the Sugar Loafe in Shorne (?or Chorne) aforesaid for that the foresaid Henry Gugley her husband is Tenn:t thereunto and payeth for the same 5:ll by the yeare & hath paid to & disposed of by the order of the said def:t Thomas Stanley tenn poundes w:ch was for Twoe yeares rent due at Michas last &that the said Henry Gugley hath a Lease of the said messuage in w:ch Lease therewas about 7 yeares to come in the yeare of our Lord 1651"
John Coosins of Chatham in the County of Kent Bricklayer aged 40 yeares or thereabouts
To the first interogatory he says that "he knoweth the peice of meadowe ground" mentioned in the interogatory. "whereof a Lease was made unto one Willyam Tayler for the Terme of 7 yeares whereupon the yearlie rent of 12:ll is received to be paid"
To the fifth interogatory he says "about 2 yeares since he bought of the said def:t Thomas Stanley ffiftie thousand of burnt bricks w:ch were made & burned by the def:t Barnabas Walsall upon p:te of the land leased to the said Barnabas Walsall by Maximilian Dallison Esq:r scituate in Chatham aforesaid & about a yeae & a halfe since this dep:t also bought of the said def:t Stanley Threescore thousand more of bricks b onely made by the said def:t Walsall upon the said Land but burned by the said Stanley for all w:ch Bricks with about 8 loads of Sand taken from the said land this dep:t paid & ?secured to the said def:t Stanley The some of Threescore & five pounds by sevall payments w:ch are all since discharged"
Zacheus ?Juitt of ffrindesbury in the Countie of kent gen: aged 57 yeares or thereabouts was deposed
In answer to the fifth interogatory he says he knws the messuage in Maidstone mentioned in the interogatory "& late in the occupacon of willyam ffrench for that he bought the same of the def:t Walsall about 12 yeares since & paid him for the same in money & by way of Exchange for tents of the dep:t scituate in Rochester to the value of 70:ll & that the said def:t Thomas Stanley doth by vertue of his ?extent receive the rents to both of the messuages latt in the occupacon of willyam ffrench & the Tents exchanged by the dep:t in p:te for the said messuage late in the occupacon of ffrench w:ch is valued at 5:ll a yeare" and that Stanley has received the rents etc.
John Jenkins of the city of Rochester victualler aged 39 yeares or thereabouts
In answer to the first interogatory the dept says he knws the messuage in the interogatory called the Golden Cork "for that he is tenn:t thereunto & hath paid unto y:e def:t Tho: Stanley for a yeare & a halfes rent for the same ended at Michas 1652 the some of 12:ll after w:ch time the said Tho: Stanley by vertue of his extent sold the Lease of the said Messuage unto one M:r ?Murns (or ??Mums) for 80:ll"
To the ninth interogatory the dept says "he was indebted unto the def:t Barnabas Walsall at the tyme of his leaving the Brewhowse for Strongbeere 14:ll w:ch was assigned by the said def:t Walsall unto the other def:t Thomas Stanley & since by this dep:t satisfied unto the said def:t Stanley about November 1651"
William Nowell of the Cittie of Rochester Victualler aged 53 yeares or thereabouts was deposed
In answer to the fifth interogatory he knows the messuage occupied by the deponent and that he pays 1§2:ll in money & taxes for 2 yeares" & that this dept is in arrerre for rent for the same Messuage for halfe a yeare for 3:ll ended at Michas last
In answer to ther ninth interogatory "he was a debtor to the said Walsall at the tyme of his leaving the Brewhowse for Strongbeere the some of 35:ll w:ch the dep:t hath since paid & seized unto unto the other def:t Tho: Stanley"
Dorothy Walter the wife of ??Gabriell Walter of Chatham in the county of Kent, marriner
In answer to the 2nd interrogatory states she has known the plaintiff Willyam Cane & the deft Barnabas Walsall & Thomas Stanley (I think she says for one year). (I can’t read the subsequent bit.)
In answer to the 4th interrogatory states she knows the Chequers and XXX. "the def:t Walsall was the true owner therof" and that the same is worth 30:ll a year in letting value
Edmond Ralph of the City of Rochester “Inholder” aged 50 yeares or thereabouts
In answr to the 4th interrogatory Ralph states "he knowethw ell both the Chequers & Cross Keyes." ??He pays for the Chequers 18:ll per year to Thomas Stanley, part of the XXXX
Thomas ?Batton (or ??Barton) the elder of the city of Rochester gen: aged 40 yeares or thereabouts
In answer to the 9th interrogatory "he about 2 yeares since paid unto the def:t Tho:Stanley 25:ll” xxxxx def:t Barnabas Walsall for strong & small beer w:ch this def:t had of the def:t Walsall"
In answer to the 13th interrogatory "he hath knowne the def:t Walsall about 14 or 15 yeares ....his abod there lived in a very good esteeme & plentifull manner"
Thomas Mott of the city of Rochester “Inholder” aged ??42 yeares or thereabouts
In answer to the 9th interrogatory Mott states that he has made payments several times in the last 2 years to Stanley xxxx
In answer to the 13th interrogatory he states that he has heard that Walsall lived in "a good xxxx....likewise that he fell into decay when he lived in Maidstone." He has known Walsall for 14 or 15 years in Rochester "where he hath dureing all that tyme dwelt in a very good esteeme xxxx"
Rob:t ffowler of the city of Rochester gen: aged 50 yeares or thereabouts
About Michas 1650 the defendants entered into an agreement with Fflowle, who bought the Messuage brewhouse, bakehouse & appurtenances thereunto. The transfer was made in May 1651 for the payment of 516: 10:s 11:d which was for debts assigned over by Stanley to the dept for "casks malt hopps hoops drayes & ?wayhorses” & for the assignment of the lease to the dep:t. The dept doesn’t think much was lost on smallbeer customers. The premises are now in the hands of ffowler, transferred at the time speciied, together with 133:ll 17:s 8d of debts from Stanley “due to the def:t Walsall for beere" being pcell of the before named sum of 516:ll 10:s 11:d. "but did not repute the same debts to be desparate”. Ffowlerefers to "the navy in harbor" and 2000:ll (in a sentence I do not understand). Knows nothing about Walsall having fallen in decay in Maidstone.
Thomas ?Shovill of the city of Rochester gen. aged 51 or thereabouts
To answer to the 7th interrogatory Thomas Shovill states that he was "Clerke unto the def:t Thomas Stanley dureing all the time that he Thomas Stanley had ?used the Brewhouse in the Interr: menconned w:ch was about a half a yeare." Refers to the def:t Walsall paying money to Stanley in payment of debts for beer.
In answer to the 9th interrogatory the deponent states that he knows that on march 28th the deft. Stanley XXXX Margaret ??fforeby the sum of eight pounds in full satisfaction of a debt of thirteen pounds which was owing
Mary Smith the wife of Willyam Smith of Chatham blacksmith aged 37 yeares or therabouts
In answer to the 6th interrogatory Mary Smith stated that her husband and she dwelt in a "Tent pcell of the p:rmisses in the interrogatory mentioned in Chatham which belonged to the brewhouse there and paid to Walsall "by the direccon & appointm:t of the def:t Stanley" 6 pounds a year, which had been paid for 2 and a half years ended last Mich.
In answer to the 9th interrogatory Mary Smith stated that her husband was a debtor to Walsall for “strong & small xxxopp & ale 22:ll whichw as paid and secured unto the def:t Stanley about 2 yeares since.”
Willyam ???ffareham of the city of Rochester victualler aged 44 yeares or thereabouts
In answer to the 5th interrogatory Willyam ffxxxx stated that he knows "the Sugar Loafe scituate in Shorne for that he purchased the same & did receive 5:ll for ayxxxx sent thereof due at our Ladxx xxxx" (plus two lines I cannot read). He also knows the parcel of meadows mentioned in the interrogatory called “the Tye” and states that its letting value is 12:ll per year at the least.
Thomas ?Scudder of the city of Rochester husbandman 40 yeares or thereabouts
In answer to the 4th interrogatory Scudder states that he knows the messuage mentioned in the interrogatory [I cannot read which one] It has a rent of 15:ll per year, which he paid to Stanley.
In answer to the 9th interrogatory Scudder states (I can’t read) xxx & Richard XXXXpp "for a waggon 4:ll & p william fxxxxx for ??whose (or ??these) 8:ll
Arnold Bradley of the city of Rochester bricklayer aged 45 yeares or thereabouts
In answer to the seventh interogatory he bought 2000 or 2000 and a half w:ch were the def:t Walsalls for which the dep:t is to pay Stanley "after the Rate of 17:s a thousand"
James Smith in the city of Rochester cordweyner aged 50 yeares or thereabouts
In answere to the 9th interrogatory Smith states that he paid to Stanley for rent xxx on "adioyning to the Golden Cock in Eastgatestreete for a yeare & a halfe 3:ll which house is since sold..." The house was sold to "M:r Almond" supposedly for a leae price of XXXX. Refers I think to the lease actually being Walsalls but Stanley receiving the money.
