Wednesday the second day
of July one thousand six
hundred ffifty and six before
the right worshippfull Charles
George Cocke Esquire one of the
Judges of the high Court of
Admiralty of England in his chamber
within the Doctors Commons scituate in
the parish of Saint Benedict neare Paules
wharfe London in the presence of Samuel howe
Notary publicke Appeared the said Smith for
the said Anthony ffernandez and Roger kilvert
and made himselfe party for them and produced for
sureties Augustine Coronell of the parish of Saint
James Duke Place London merchant and John
Bellamy of the parish of Alhallowes Barkinge
London Wine Cooper whoe submittinge themselves to
the Jurisdiction of this Court obliged them selves
their heires executors and administrators for the said
Anthony ffernandez and Roger kilvert in the summe
of Twoe thousand and ffoure hundred poundes of
lawfull money of England to the said Michael De
haze and Company to answeare the Action by
them commenced against the said ffernandez and
kilvert and to pay what the said ffernandez and
kilvert shall bee condemned in with expences of suite
in case they shall bee overthrowne and to bringe
forth the said ffernandez and kilvert in Judgement
whensoever then presente shall bee thereunto lawfully
required And the said ffernandez obliged himselfe
his heires executors and administrators in the same
summe and to the same effect and to save the said
Coronell and Bellamy this sureties harmeles And
unles they shall see doe they they doe consent that
execution shall bee granted against them theire
heires Executors administrators and goods and
Chattells wheresoever the same shall bee found to
the value of the same summe of Two thousand and
ffoure hundred poundes Which Caution the Judge
did receave and did decree the said ffernandez
and kilvert to bee released from the said arrest in
case nothinge shall bee objected against the
sufficiency of the said security within twoe Dayes
by Master Suckley whoe desired untill that
time and noe longer for that purpose/.
