Which day the said Smith appeared for
Thomas Burton and made himselfe party
for him and alleadged that the said shippe
was formerly called by the name of the Peter
and was taken by a private man of warre sett
out by some of the subjects of this Comonwealth
and adjudged by this Court for lawfull prize and after
Judgement sould unto the said Turnor and that he is in
the possession thereof and doth belong unto him and offered
to give security to answeare any action that the said Suckleys
Clyents have against the said shippe in the presence of the said
Suckley dissentinge and desiring time to acquaint his Clyents with the
security tendred by the said Smith Whereupon the Judges did decree
the said shippe to be released from the said arrest the said Burton first
giving security in this Court to the effect thereafter expressed. Then the said
Smith produced for sureties Richard Netwmaker of Bennet Gracechurch
London Cordwainer and Robert Louet of Saint Saviours in Southwarke haberdasher
