Transcription

Clyents have against the same Whereupon the Judges did with the
consent of the said ffrancklin and Suckley in regard the said shippe is laden did
decree the said shipp to be released from the said arrest security
being first given by the said Nicholson to pay the freight which shall
grow due for the same to whom this Court shall adjudge the same and
to abide the Judgement of this Court aswell in the possession in
case this Court shall upon a summary hearinge find cause to
adjudge the possession thereof to the said Sherwell as alsoe in the
petitory and to pay what the said Nicholson shalbe condemned in
with expences of suite in case he shalbe overthrowne Then the
said Suckley produced for sureties John Poole of Saint
Gregories London vintner and Roger Coniers of the parrish of Saint
Andrew Wardrobe London vintner who submitting themselves et cetera
obliged themselves et cetera for the said Sampson Nicholson in the summe
of 500 li of lawfull money of England to the said Thomas Sherwill
to the effect before expressed And unles et cetera./.

The Lord Oxinsterne and others against}
Chelston Suckley Smith}

Which day the said Suckley appeared for
the said Lord Oxinsterne and others
and made himselfe party for them and Smith
for the said Chelston in whose presence the said
Suckley gave a libell in writinge which the Judges
at his petition admitted soe farre as the same is by
law admissible which being soe admitted and repeated
and the said Smith not beleeving the same to be true the
Judges assigned the said Suckley to prove the same the
third Court day from hence and decreed for the party
principall the third day after if et cetera Then the said Suckley upon
the said libell produced for witnesses John derrickson and hance
Johnson whom the Judges receaved and administred an oath into
them to speake the truth at the time of their examination in the
presence of the said Smith dissentinge and having the usuall time fore
Interrogatories./.

Which day the said ffrancklin alleadged
that he hath comitted an error in
the taking out the warrant against their
said parte and therefore he desired
a new one to be granted and thereupon
the Judges did supersede the said former
warrant and granted him a new one
returnable upon thursday next./.

George Cocke Esquire Judges et cetera in the presence
of Samuel howe Notary publique Appeared
the said Lewellin under the custody of the Marshall
and alleadged that an execution hath issued out under the
seale of the Court against him for the wages adjudged by
this Court and that he being owner but of 3 16th parts of
the said shipp hath paid almost his whole proportion of the
wages
