Which day the said ffrancklin appeared fpr
the said Griggs and made himselfe party
for him and produced for a suretie Thomas
Sherwill of the parish of Saint Thomas Apostles
London merchnat who submittinge himselfe et cetera
obliged himselfe et cetera for the said George Griggs
in the summe of 50 li of lawfull money of England
to the said ffrancis Lenthall to answeare the action in
this behalfe commenced and to pay what the said Griggs
shalbe condemned in with expences of suite in case hee
shalbe overthrowne And inles et cetera./.

Which day the said Budd exhibited and left in the
Registry of this Court the Charterparty amade and signed by
the said ffairfax mentioned in the proceedings of this cause
and the Judges with the consent of the said Budd and Smith did
pronounce the said charter party and the charter party signed by
the said Jopp for the voyage in question and left in the
Registry of this Court to be void and cancelled./.

Clements Smith}
Which day the said Smith alleadged that Clemicke the
party whose wages in this cause are controverted did
in his life time receive in parte of his wages demannded
in this cause of the East India Company or by their
order the sume of 22 li 10 s Which allegation the said
Smith proposed joyntly and severally and the Judges
admitted the same soe farre as the same is by law admissable
Which said allegation beinge soe admitted and repeated and the
said Clements not beleevinge the same to be true the Judges
assigned the said Smith to prove the same the second session of
the next Tearme and at the petition of the said Clements in
regard it appeareth that there is 9 li 10 s confessed to bee cleerly
due for the wages of the said Makins the Judges did decree the
said Cockaine to be monished to bringe Clemicke the same into Courte./.

Which day the said Budd desired the sentence given in
this cause to be putt in execution in the oresence of the said
Suckley dissentinge and alleadging that this cause is
appealed and in Inhibition exercised upon this Court and
that the Commission of Appeale doth remaine in the
delegates office and offered to shew the same the said Budd
dissentinge and alleadging that in case any appeale were interposed
yet the same is dissolved and he read a copy of the [?disXXXision]
thereof Whereupon the Judges upon consideration of the whole
matter did decree the said Vincent and his sureties to be monished
to pay the summe of 122 li 10 s adjudged by sentence of this Court
to the said Sowden within fourteene dayes after monition or
otherwise to be attached./.

That by the Acts and Statutes of this
Comonwealth it is enacted and ordained That

gallons and noe lesse and soe much is usually sold
