and company and passengers in her were in eminent danger of perishing
and sinkeing in the sea whereupon it was by the advise of the sayd
Croford and his mates and the passengers aboard agreed that for the preservation
of the sayd shipp and their lives it was more [?ffaire] to throwe some goods over
board to lighten the shipp whereupon the sayd eight hogsheads of sugar and some other
goods which laye betweene decks and were most cumbersome and trouble
some to the hinderance of the preservation of the sayd shipp and the rest of her ladeing
were throwne over board and were lost and perished in the sea, which could
not bee avoided without the eminent hassard of the losse of the shipp and
all her ladeing and her Companyes and passengers lives And hee this deponent
verily beleeveth and is perswaded in his conscience that the sayd Croford and
Company would not have taken the sayd Bellingers eight hogsheads
of sugar on board the sayd shipp if they had in the best imagined that
they should have runne any adventure thereby but were induced to take the
same aboard by the sayd bellingers promise to runne the risque
thereof if any casualty came thereto as aforesayd And further hee
cannot depose./
To the Interrogatories./ [CENTRE HEADING]
To the first Interrogatorie the danger of periury being declared unto him as is
therein required hee saith hee was Gunner of the shipp Gilbert the voyage in
question and saith the sayd Bellinger went from England to the Barbados in
the sayd shipp and that hee knew him not before his Coming a board the sayd
shipp and that hee knew none of the parties litigant before the voyage in question/
To the 2 Interrogatorie hee saith hee hath receaved all his wages for the voyage in question
save twenty five shillings which as hee beleeveth is stopped by reason of
the losse of the sugar in question And further hee cannot answere/
To the 3 Interrogatorie hee saith hee knoweth not who signed the bills of lading Interrogate
whether the Master or the purser, And saith hee doth not remember that any body
came in company aboard the sayd shipp with the sayd Bellinger when hee
desyred to have his sugars laden as aforesayd and made promise to the effect
predeposed And further cannot answere./
To the 4th Interrogatorie hee saith the sayd sugars were stowed betweene decks, and
that there were about twenty tonnes of other goods stowed betweene decks before
those sugars came to the shipp side, but to whome they belonged hee knoweth not
And saith it is usuall for shipps that come there in Summer tyme (but not in winter tyme)
to stowe sugar betweene decks if soe desyred by the merchants
at the Barbados And further hee cannot answere/
To the 5th Interrogatorie hee saith hee beleeveth that if the shipp Interrogate and her
Owners bee freed of the losse and damage of the sugars in question hee shall
receave the 25 s which is stopped of his wages And to the rest of the Interrogatorie
hee answereth negatively./
To the 6th hee saith hee favoureth all the parties litigant alike and desyreth
right may prevaile in this cause./
