contract for the number of gallons to the tonne, and being the
usuall and accustomed gage of sweete oiles. And otherwise hee
cannot depose saving as aforesaid.
To the 6 article hee saith that about some monthes past (the
time otherwise hee nowe remembreth not) the said Brewar in further
persuance of the said sale of the said oiles, paid unto this deponents
servant a certaine summe of money (howe much hee nowe
remembreth not) for or towards payment of the excise of and
for the said oiles, which money this deponents servant received, And
otherwise saving his foregoeing deposition hee cannot depose.
To the 7th eighth and 9th articles hee saith and deposeth that
after the said buying by this deponent and his selling the said
oiles to the said Alderman driver, hee delivered a note to be signed by
the said Brewar for transferring them to the said Mr driver, and
the said Brewer received the same upon the exchange London in
the presence of his precontest humphrey Browne, which note
the said Brewer put into his pocket, and refused to goe off
the Exchange to signe it. And saith that longe beforre that the said Brewar
spake to this deponent, and
desired him to goe alonge with him to the Prize office and there
to declare that the Commissioners ought to make Deliverie of the
said oiles to the said Brewar after 252 gallons to the tonne, and
held up a bagge of money, wherein (as the said Brewar said) was about 15 li sterling
and offered it to this deponent of hee would goe and soe declare, for
that (as hee said) hee doubted not but that if this deponent would
soe declare, hee the said Brewar should
receive the said oiles after that [?rate]; And this deponent refusing
to goe, as knowing it was a gage that the Commissioners had
never intended nor had delivered in any sweete oiles
they had sold, and telling the said Brewar soe and this deponent [?expected] but 236 gallons to the tonne in what hee had bought of the said [?BXXXX] the said Brewar
still continued to importune him to goe, and this deponent
upon his importunitie went with him, but comming thither this
deponent told the Commissioners the very truth of what the said
Brewar came about, and what in effect hee had said to this deponent.
And the said Brewar could not nor did make any deniall of the
matter. And otherwise hee cannot depose.
To the tenth hee saith hee hath bin often informed and beleeveth
that the said Brewar refuseth to receive the said oiles
unlesse hee may have them at 252 gallons to the tonne, and
soe much hee hath heard the said Brewar confesse, And
otherwise hee cannot depose.
To the last hee saith his foregoeing deposition is true.
