as a shipp under sequestration and observed that the sayd Captaine Trevire
and his company were then out of possession of her, and had bin turned out of
possession of her as this deponent hath heard for a longe tyme before that, And saith that hee well knoweth
and observed that the sayd shipp the Chapman continued in the possession of the sayd
King of Portugall all the whole Summer tyme 1651 and was sent out
upon the sayd Kings imployment and service from Lisbone, but how longe shee
continued in his Kings service after hee this deponent soe sawe her at Lisbone
otherwise then before hee hath deposed hee cannot depose And further to this
article hee cannot depose for that hee was not at the Mederas nor sawe the first
seizure of her which hee hath heard was made in the Maderas in the yeare 1650/

To the 3 hee saith that hee this deponent seeing the sayd shipp at Lisbone
the tyme aforesayd, did observe that shee was a shipp of the burthen of
three hundred tonnes or thereabouts and had then about twenty peece of
ordnance Annd saith that in his this deponents Judgment and estimate
a shipp of such burthen (sufficiently victualed for thirty sixe men as
is arlate and provided with all other necessaries of Ammunition and
provision), might be well worth (besides Mariners wages) one
hundred and tenn pounds sterling per moneth, And further to this article
hee cannot depose for that hee was not present at her seizure
in the Mederas nor knoweth how shee was then provided either with
victualls men or ammunition./

Examined upon the sayd allegation

John Wilkey of Ratcliff in the parish of Stepney
and County of Middlesex Mariner aged 45 yeares or
thereabouts a wittnes sworne and examined saith and
deposeth as followeth videlicet.

To the first article hee saith that hee this deponent being at Lisbone
in Portugall during the Months of March Aprill May June
July and August 1651 and for divers moneths after, did in the sayd tyme and
months heare the arlate Nicholas Trevire (who was then commonly
reputed to be Master of the arlate shipp the Chapman) declare and
affirme that the arlate Robert Rich was Owner and Proprietor of
the sayd shipp And the sayd Trevire (for that hee could not
well reade written hand himselfe) did shew this deponent in the moneths
aforesayd severall letters from the sayd Robert Rich wherein hee did
as Owner of her prescribe and give orders to the sayd Trevire touching
the busines of the sayd shipp And further to this article hee cannot depose/
