To the third and fourth articles hee saith and deposeth that within the said time
the said producent or his servants or agents by his order bought and provided
all and singular the said goods wares and marchandizes mentioned and expressed
in the said first and second schedules and paid for the same the severall and
respective summes of money mentioned and expressed in the said schedules
as in and by the said bookes of the said producent (which this deponent
hath perused and hath nowe extracts thereof with him and which hee beleeveth to be true) is to be seene
And otherwise hee cannot depose, saving hee beleeveth those to be the
currant prices of the like goods at those times in this citie.
To the fifth hee saith hee hath alsoe seene the customes, dying, [?package]
and other charges of the said goods to be entred in the said producents bookes as paid by him
according to the said schedules. And otherwise hee cannot depose, saving
hee verily beleeveth the said entrie to be true, and the said charges to have nbin
paid accordingly.
To the sixth hee saith that by the said bookes and entries hee
hath found and knoweth that the said producent according to the said
order of the said Marcus de la Rumbida (having bought and provided
the said goods mentioned in the said schedules) sent them unto the said Alonse
da [?Sierra] and dominga da Saricolea for the use and accompt of the said
Rumbida, and by the letters both of the said Rumbida, and alsoe of the
said Sierra and Saricolea sent to the said producent (and which this deponent
hath seene amongest his papers) the sending and receipt of
the said goods in Spaine for the said accompt is acknowledged and
confessed. And otherwise hee cannot depose.
To the seaventh hee ssaith that in and by the said originall letters of the said
Rumbida (which this deponent hath seene as aforesaid) the said Rumbida hath
promised and undertaken to pay and satisfie the said producent for
the said goods wares and merchandizes, together with all charges and
expenses thereupon and thereabouts, referring himselfe to the said
schedules and to the said bookes of entries and accompts for the summe
or summes. And otherwise hee cannot depose.
To the eighth hee referreth himselfe to his foregoeing deposition, and cannot
otherwise depose.
To the nineth hee saith that by severall letters sent by and from the said
producent to the said Marcus de la Rumbida (some of which letters this deponent hath
written and hath seene copied others of them) the said Marcus de la
Rumbida hath bin requested and desired to pay and stisfie unto the
said producent the said moneyes due for the said goods expressed in the said
schedules, according to the summes therein set downe, with interest and
dammages for the same as is arlate, but the said Rumbida hath refused
payment (as this deponent hath seene by letters) whereby the said producent
as hee beleeveth is damnified 2000 li sterling over and besides the [?XXX]
principall. And otherwise hee cannot depose.
