Transcription

To the first article of the sayd allegation hee saith that hee being a member
of the Corporation of ffeversham well knoweth that about twenty yeares since
the ffishermen tennats of the Mannor and hundred of ffeversham did borowe
out of the chamber of ffeversham about twenty or thirty pounds for the
storeing of the grounds arlate now in question with oysters and hath
credibly heard from aunchient men Inhabitants of the sayd Mannor and hundred of ffeversham that from tyme to tyme and beyond memory of men now liveing they have used and doe use to stoare
the sayd grounds with oysters which they buy out of Essex and other places, And
saith the tennants of the sayd Mannor and hundred have as is predeposed to the
allegation made in the acts of Court constantly fished the sayd
grounds in question to their owne proper use and benefit, exclusive from all
others the ffishermen of Strowde Gillingham Milton or other places adiacent
(except such as have secretly and by stealth as aforesayd fished there) And saith
hee never heard nor beleeveth that any the ffishermen of Strowd Gillingham
Milton or any other save the Tennants of the hundred and Mannor of ffeversham
did at any tyme store the sayd grounds with oysters or laye out any money
thereabout or ever had any right of fishing there And further to this article hee cannot depose/

To the second hee saith that hee hath observed for these twelve yeares
last past that the tennants of the
Mannor and hundred of ffeversham doe usaully every yeare watch upon the oyster
grounds arlate from about Lammas till after Michaelmas to prevent
(as much as they [?can]) any persons but such as are Tennants ffishermen of the mannor
and hundred of ffeversham from fishing for any in store on the sayd ground[?s],
and this deponent hath divers tymes seene them soe watch having occasion
to passe by in a boate And saith hee hath heard divers of the tennants of
the sayd Mannor and hundred saye, that it costs them weekely thirty and somtymes
forty shillings a weeke during the tyme they soe watch, And hee this deponent
hath heard by common fame and report that they have soe used to watch the
sayd grounds tyme out of mynde and memorie of men now liveing, And saith
hee never knew nor hath heard that any the Inhabitants of Strowde Milton
Gillingham or any but the Tennants of the mannor of ffeversham did at
any tyme watch the sayd grounds or pay for the watcheing of them, And
further to this article hee cannot depose saving his foregoeing deposition/

To the last hee saith his foregoeing deposition is true./

To the Interrogatories./ [CENTRE HEADING]

To the first Interrogatorie he saith hee cometh to testifie the truth
of his knowledge in this cause without compulsorie, being soe
required by the producents who promised to beare his charges, and saith hee
is noe fisherman of ffeversham or any other place nor hath fished at any tyme in the grounds in
question, and would give the victorie in this cause to whome of right it belongeth
and saith it will be neither preiudice nor advantage to this deponent
which soever of the parties litigant prevaile And further to this Interrogatorie hee
cannot answere./
