Transcription

moneth of Aprill of the said yeare sett saile from Middleborough to
Bayonne in ffrance, and that by this deponents direction as gacing an
order to that purpose from the said producent, and saith that shee thence
proceeded to Mallega upon the Voiage in Controversie, her said first setting
out from Middleborough (as predeposed) being before any hostility broke
forth betweene the English and dutch Nations, And saith that
although the said shipp and goods were ordered and designed upon the
Voiage in question to returne and come to Zeeland, yet the said
shipp and goods were in trueth and realitie to bee disposed of by this
deponent to and for the said producents use and accompt, according to
such orders and directions as hee this deponent upon their arrivall
should receive from the said producent, for and concerning the disposall
thereof And that this deponent was either to have sent the said goods
to Ostend to the said producent, in kind, or otherwise according to
his order and for his sole accompt to have sold or disposed of the same
to the producents best benefitt and advantage. The premisses hee
declareth upon his oath Conscience and salvation to bee reall
and true, as having infallible knowledge thereof by meanes of the
trust reposed in him, and his employment in and for the said
producents affaires, and particularly this before declared in and
during the said producents absence and exile as aforesaid. And
further hee cannot depose:-/

To the 5th hee saith, That the said daniel Thyson the producent
in this Cause was and continued a Burgher in and of Terveere
in Zeeland and a Subject of the States of the United
Netherlanads till about the moneth of September 1651 at
which time by publique Sentence and proclamation from the
Lords or Magistrates of Terveere aforesaid hee was totally exiled
and abdicated out of their territories and dominions of holland Zeeland and [?XXX]
deprived of all Priviledged and freedomes to their Subjects belonging
by meanes whereof hee was necessitated to retreat into
fflanders as aforesaid, at or about which time hee as admitted and
received free Nurgher of Ostend as aforesaid, and thereby a
Subject of the king of Spaine, and did and doeth enjoy all the
franchises immunities and tuition to such a Burgher and Subject
appertaining, The premisses this deponent knoweth upon the grounds
predeposed, and for that this deponent hath in that condition for all
time hold correspondence with, and done the businesse of the
producent as his Agent, and hath beene with him in his house
att Ostend. And otherwise cannot depose/
