with a stronge and sufficient hawser, and laye and continued there soe
safely moored by the space of eight howers or thereabouts, And hee saith the
said Buttolphs Wharfe is a usuall, and convenient, and safe place for mooreage
of lighters, And alsoe saith that the arlate Gyles Travers was and is
Commonly reputed the lawfull Owner and Proprietor of the sayd wines soe
laden aboard the sayd lighter, and saith that hee the sayd Travers did as
Owner thereof speake to this deponent to procure him a lighter for carriage of
the sayd wines from on board the sayd ship to Buttolphs wharfe, and this deponent
did accordingly bring the sayd Thomas Taylor the Master of the sayd Lighter
to the sayd Travers who agreed with him the sayd Taylor for carrying the
sayd wines to Buttolphs wharfe and this deponent knoweth that the sayd
wines now controverted did safely arrive in the sayd lighter at Buttolphs wharfe
and were there safely and well moored during the tyme predeposed, for that hee this
deponent was and is Wharfenger of the sayd Buttolphs Wharfe and sawe her
there safe moored as aforesaid, And further to these articles hee cannot depose/

To the 3 and 4th articles of the sayd libel hee saith that after the sayd Taylors
Lighter was safely moored at Buttolphs Wharfe as aforesaid with the wines
in controversie on board her, a lighter belonging to the arlate Pomery and
of the burthen of about eightie tonne laye moored a head of the sayd Taylors
Lighter soe laden as aforesaid, And saith that hee afterwards sawe that the
hawser of the sayd Taylors lighter was broken and the sayd Lighter driven a
drifte, and this deponent goeing on board the sayd Taylors lighter after shee
was againe moored at Buttolphs Wharfe did observe that a pipe of wine
onboard her was staved, and hath heard the same was soe staved by reason
the sayd Pomeroyes lighter fell fowle upon the sayd Taylors lighter and further
not being present when the disaster arlate happened hee cannot depose/

To the 6th hee saith hee verily beleeveth and is perswaded in his conscience that
in case the sayd Pomeroyes Lighter had not (as is sayd) fallen fowle of the sayd
Taylors lighter the sayd Taylors lighter and her ladeing would have continued
safe and in good condition, the same being as aforesaid, of this deponents sight and
knowledge very well and safe moored at Buttolphs wharfe aforesaid. And
further hee cannot depose./

To the last hee saith his foregoeing deposition is true/
