To the 8th hee saith hee was not present at neither saw any

Examined upon an allegation given in the 11th day of July 165[?4]
on the behalfe of the sayd William Mayer./.

Christopher Downes of the parish of Stepney and County of
Middlesex mariner aged 36 yeares or thereabouts a witnes sworne
and examined saith and deposeth as followeth videlicet./

To the first article of the sayd allegation hee saith that hee this deponent
went Boatswaine of the arlate shipp the Guifte of Topsham and the
arlate William Mayer Master of her during the voyage in question
And saith that hee knoweth that the arlate Thomas Pitt and James
Marshall were the only Merchants concerned in the lading of the sayd
shipp and who did take upon them to give orders for and be concerned in her
sayd ladeing the sayd voyage And this deponent knoweth that the saud Pitt
and Marshall were the only persons who caused the sayd ladeing to be
laden on board the sayd shipp the sayd voyage and this deponent
being Purser did enter all the sayd ladeing in his booke as belonging
to them the sayd Pitt and Marshall and the same was all marked with their
markes as belonging to them and hee this deponent never heard
or knew that the arlate Richard Westcombe or any other person whatsoever
(except the sayd Pitt and Marshall ) had any interest or was any way concerned
or gave any orders to the sayd William Mayer the sayd voyage touching any
the sayd ladeing in question And further to this article hee cannot depose

To the 2 article of the sayd allegation hee saith and deposeth that hee
this deponent understanding before the sayd shipp the Guifte sett sayle
from Topsham arlate upon the voyage in queation that the sayd shipp was
to goe from thence to the Barbathoes and there lade sugars and tobaccoe and
transport the same thence to Bilbao arlate and deliver it there and this deponent well knowing
that such goods were in Spaine Contrabanda goods if brought thither without
speciall licence first obteyned from the King of Spaine or his officers and
would be there seized and hazard the losse of them and what other private
adventure of the same quality any of the sayd shipps Company should have on board her at
her arrivall at Bilbao, did in behalfe of himselfe and the rest of the sayd
shipps company signifie unto the arlate Thomas Pitt then on shipp board that hee this deponent
and the rest of the sayd Company for the reason aforesayd were unwilling to
proceede on the sayd voyage and lade sugar and tobaccoe at the Barbadoes and deliver
the same at Bilboa unlesse a speciall license were procured soe to doe
whereupon hee saith the sayd Thomas Pitt did (before the sayd shipp departed
out of harbour from Topsham arlate) before this deponent and diverse others
of the sayd shipps company faithfully promise the arlate William Mayer
and this deponent and the shipps company that if they would proceede on the
sayd
