Transcription

To the second Interrogatorie hee saith and deposeth that the said shipp departing
as aforesaid from Palma for Southampton, and comming in her course of
proceeding within two or three dayes saile of the English coast was met
by three holland men of warr [?or ?man of warr] of the States of the
United Netherlands, who set upon her and after some time of fight
and resistance they mastered and tooke and seized her on or about
the nine and twentieth of Aprill last, and carried her and her said
lading to Viego in Galicia, where the same were adiudged and condemned
for prize unto them, and thereby utterly lost to the owners, all which
hee knoweth being aboard and seeing the said seizure, and being in and
of the man of warr carried to Viego in her company, and being there
when shee was soe adiudged, and afterwards seeing diverse of her goods
carried out and staying there till shee was clearely unladen to the
use of the said takers. And saith the said shipp and setting out were
commonly reported to be worth and to amount to [?1600 li], and that the
said ffrancis Tatwell had a quarter part of the shipp as aforesaid.
And otherwise hee cannot depose.

Examined upon the foresaid allegation.

Captaine John Arthur Vice Admirall of the
County of dorset, aged 50 yeares or thereabouts
sworne and examined.

To the first article of the said allegation hee saith and deposeth that after
the seizure of the shipp the Elizabeth of deep and her bringing into
Weymouth, the master and some of the company of her being at Weymouth examined
before this deponent, did in his presence and hearing confesse and
acknowledge that shee belonged to deep, and was thence set out on her
voyage for the Charibbe Ilands. and that her owners were all ffranchmen
and subiects of the ffranch kinge and living in deep. And that shee
had taken in her lading wherewith shee was seized at the Charibbe
Ilands and was going therewith when shee was seized for deep
there to discharfge for the account of ffranchmen, subiects as
aforesaid, and would have gonne thither of shee had not bin
mett with and brought up by the dragon frigot, and this their
confession was soe made about three monethes since.
