The 21th of May 1655. [CENTRE HEADING]
The Lord Protector against}

Examined upon the second allegation given in
by Mr Budd.
Rowe dt.

John Holme of the parish of Saint Magdalens Milkestreet
London haberdasher, aged 30 yeares or thereabouts
sworne and examined.
To the first article of the said allegation hee saith and deposeth that
hee this deponent being a Warehouse-keeper under the Commissioners
for prize goods, hath had the custodie of many parcells of sweete
oiles, brought in as prize, and hath delivered out many parcells
that have bin sold by them, namely hee hath as hee beleeveth delivered
out within the space of a yeare (ending about August
last) above fiftie tonnes of sweete oiles to severall persons to whom
they were sold by the said Commissioners or to the assignes of those persons. And saith hee never
delivered moreor after any other then 236 gallons of sweete oiles
to the tonne, nor was there any other or greater gage or other number
of gallons to the tonne than 236 demanded of
him by any of the said persons, And in particular hee saith that
amongest the parcells soe by him delivered, there were above 30 tonnes
of sweete oiles, which came out of the same shipp (namely the Greate
Saint Marke) out of which the oiles in controversie came, yet there was
not any demannd ,made nor were they delivered at more than 236 gallons
to the tonne. And at the gage aforesaid of 236 gallons to the tonne the
buyers of all the foresaid oiles soe delivered as aforesaid by this
deponent, have received the same, well satisfied, never demannding
or soe much as mentioning any greater number or gage. And saith
that for two yeares space that hee hath bin acquainted with the
gage of that sort of commoditie (having soe long bin in the said
imployment) 236 gallons to the tonne of sweete oiles hath commonly
bin accompted the right and full gage of sweete oiles betwixt buyers
and sellars of prize goods and hee beleeveth the same to be the gage
amongest merchants. And otherwise hee cannot depose.
Upon the rest hee is not examined by direction of the producent.

To the first second and third hee hath not soe deposed, and therefore
they concerne him not.
To the 4th negatively.
To the 5 negatively for his part and otherwise hee cannot danswer.
