happened as this deponent remembreth about 11. of the Clocke in the Morning
this deponent being above the decke of the said shipp Mary togeather with the said
Robert Yaxley, this deponents precontests and Companie And further cannot
depose./

To the second hee saith, hee hath no part or share in the said shipp Mary, And
saith, That all the said shipps rigging and furniture spoyled and damnified
by the meanes aforesaid were either new or very sufficient and serviceable as
could be desired for such a shipp, and is in Conscience perswaded that before
they were so damnified as is predeposed, they were really worth 200 li sterling
and upwards, but since they are damnified are of very little valew, videlicet of
the valew of about 10. or 12. li as hee verily beleeveth, and saith that such of the
said tackle as may be et made serviceable with some expense, doe now remaine
aboard the said shipp Mary. And further cannot depose./:

Lord Protector against Pibus aforesaid}

Examined upon the foresaid allegation on the behalfe
of the said Pibus.

Rp. 3.

John Haige of Shadwell in the County of Middlesex
mariner, aged 55 yeares or thereabouts sworne and
examined.

To the first article of the said allegation hee saith and deposeth that the vessell
the Martha arlate (whereof the said John Pibus was commander) went out
upon the voyage arlate in or about the moneth of May 1653, which hee knoweth
because hee went out Steward in her, and saith that when shee soe went out
there were Embassadors or other publique Ministers here in Engand (as hee
was credibly informed) from the States of the United Netherlands treating about
making of a peace betwixt this Commonwealth and the said States, and
there was then (as the common report went) greate hopes and probabilities
of effecting the said peace and agreement. And otherwise hee cannot depose.

To the second hee saith that the said mr Pibus the said voyage went
out upon a fishing designe for Greenland, and thence to retourne to this Port
in the imployment of certaine merchant, and was obliged to have a certaine
number of men to manage and prosecute that designe, and hee had
the said number (being about three score) and noe more. And this deponent
never heard of any Commission or letters of marque that the said Pibus had
to seize any shipps or goods that voyage; And verily beleeveth hee had none;
for if hee had, this deponent verily beleeveth hee should have knowne or
at least have heard thereof, being one of his company as aforesaid.
And otherwise hee cannot depose.
