have sufficeint dammage to the value of fiftie or fortie pounds sterling which ought
very well have been clearley gained to the said Owners by such a Voyage, if the said
shipp had not bin retarded by the meanes aforesaid. And further hee cannot
depose./

To the 4th hee saith hee referreth himselfe to the Acts and proceedings of this Court
concerning the Cause in question. And further cannot depose:/

To the last hee saith his foregoeing deposition is true./

To the Interrogatories:-/ [CENTRE HEADING]

To the first Interrogatorie hee answereth and saith, That hee cometh to declare the
trueth of his knowledge as a Wittnesse in this Cause by the meanes and
procurement of Robert Yaxley Master of the said shipp the Mary, and was aboard the
said shipp and Masters mate thereof at the time of the dammage sustained as
aforesaid, which happened about 10. or 11. of the Clock in the forenoone, this deponent
together with the said Yaxley , and his this deponents Contests and others being above
the deck of the said shipp Mary at the time aforesaid. And further cannot depose

To the second hee saith hee hath no part or share in the said shipp the Mary
And saith that the Mats spoyled in the said encounter were not new, but very
serviceable and sufficient, and that the sailes shrowdes standing and running
rigging damnified by the meanes aforesaid were a great part
of them newm and the rest very strong and serviceable, but what the particular
valewes of the said masts yards shrowds sailes and rigging were either before
or after the damnifyeing by the meanes predeposed, this rendent saith hee cannot
declare; but saith the sailes belonging to the said shipp, and damnified as is
predeposed, mayu as hee beleeveth, with some expense be made indifferet serviceable
againe, and saith the said sailes and such other furniture as were not quite spoyled
or lost in the said encounter are and doe remaine aboard the said shipp the Mary
And further cannot depose./

Samuel Browne of Alborough in the Countie of
Suffolke Mariner Boateswaine of the said shipp the
Mary aged 50. yeares or thereabouts a Wittnes sworne
and examined saith as followeth videlicet:-

To the first article of the said Allegation hee saith, That hee hath well knowne the
shipp Mary arlate for theise 12. yeares last past or thereabouts. And saith That
in the moneths of August September and October in this present yeare 1654. and
for severall yeares before and at this present the said shipp with her tackle furniture
and appurtenances hath belonged, and did and doeth lawfully belong to the arlate
Robert Yaxley now Master thereof, and to George Blowers and Arthur Blowers
of Alborough aforesaid and Companie, who were and are the true and lawfull
Owners thereof, and for such commonly accompted reputed and taken. The premisses
hee knoweth having resided at Alborough aforesaid for about 26. yeares last
past, and hath sailed in and served aboard the said shipp the whole sommer last
past. And further cannot depose
