apparell and furniture, and as owners fitted and furnished her out
upon the said voyage and bought her shortly before the same of this
deponents certaine knowledge, and saith they had each of them a third
part in her, the shipp being devided or owned in three parts. And
for and as owners of the said vessell in thirds the said producents were
and are commonly accompted and reputed, yeelding a reason of his
knowledge as afore, namely that hee was master of her, and constituted
master by them and privie to their fitting, and setting her out as
sole owners thereof: And otherwise hee cannot depose.

To thethird Interrogatorie hee saith and deposeth that the said
shipp departing as aforesaid from Wexford and prosecuting her
said intended voyage for Rochell or Nantes, was about 6 leagues
off Ushant about seaven weekes since chased by an
Osetnd man of warr (Peter Blinckorne Captaine) and after about
six houres space fetched up, assaulted, surprized and taken by the
said man of warr, which carried her to Ostend, and there this deponent
used his utmost endeavour in the Admiraltie and otherwise for her
recoverie, but could not regaine her, for hee saith shee was there
confiscated as being bounf for ffrance to discharge, and sold and disposed
of by the takers or others there, soe that shee was and is utterly
lost to the said producents, without any manner or recompense or
any satisfaction made to them for her, all which hee knoweth
being aboard when shee was taken and carried to Ostend in the
man of warr in her companie, and being there when shee was
confiscated, disposed of and finally lost to the producents.

Richard fford of London Merchant, aged 40
yeares or thereabouts sworne before the
right Worshipfull William Clerke doctor of lawes
one of the Judges of the high Court of the
Admiraltie, saith and deposeth by vertue
of his oath.

That the factor of him this deponent and of the said Thomas fford hath
about a fortnight since laden aboard the said shipp the Saint Nicholas at
hamburgh for their accompt twelve packs of linnen cloth 651 41/2 staves
of iron, one fatt of [?shaven lattin], nine single and foure fatts of double white lattin
six steele barrells 780 bundles containing 9160 pipestaves 250 pipes in faggot
