The Lord Protector against Pibus}

Examined upon an allegation made by Mr
Budd in the acts of Court the 6th
of this instant. and a schedule therein
mentioned.

Edmund Kelsall of the citie of Westminster gentleman aged
27 yeares or thereabouts sworne and examined.

To the said allegation and to the exhibit therein mentioned beginning and
ending as in the same is deduced, nowe showed unto him hee saith and
deposeth that on or about the fourth day of January 1653, hee this
deponent together with his contest Captaine Michael Robinson, and
one James Bates were present with and in company of Captaine
John Pibus allegated at the Castle taverne at Paulschaine
London, and there they discoursed of and about a holland shipp which
the said Pibus had taken in the shipp the Martha comming
from Graenland, and which hee had letten goe againe, and then and
there the said Pibus made a confession and a declaration touching the
said shipp in all things as in the said schedule is sett downe, the
contents of which schedule were writte downe by the said James
Bates from the mouth and in the presence of the said Pibus and of
this deponent and the said Robinson, and being soe written it was
read verbatim over to the said Pibus, and hee the said Pibus alsoe read
the same over himselfe and acknowledged the same to be wholly true
and then and there hee the said Pibus with his owne hand subscribed
his name thereto as nowe appeareth in the presence and sight
of him this deponent and of the said Bates and Robinson, And
otherwise hee cannot depose.

To the Interrogatories. [CENTRE HEADING]

To the first hee saith the said Pibus was a prisoner and under restraint
at the time aforesaid of the said writing and acknowledging the contents
of the said schedule, but saith hee was not urged or threatened to the
said subscription by this deponent or any other in his hearing, but hee
having made the said confession first verbally, this deponent and
the said Robinson and bates desired him to give [?XX] [?under]
his hand, which hee willingly did, and saith the said Pibus was then
a prisoner to this deponent and Captaine Robinson, who had a
speciall warrant for his apprehension, and had him then in their custodie
And otherwise saving as aforesaid hee cannot answer.

To the second hee saith that hee [?prosequuteth] the said businesse
according to act of Parliament, without expectation of any benefit
thereby, but for the service of the Commonwealth, and hee
desireth that Justice may take place, and referreth himselfe to
the act of Parliament in that behalfe touching any share that should
accrew unto him, denying that ever hee or any other to his knowledge
threatened the said Pibus to the effect interrogated or otherwise
And otherwise saving as aforesaid hee cannot answer
