being Sub Commissioner to the Commissioners there and being (as hee remembreth) told by the Sub Collector for Customes that hee was satisfied for the same after 1 d per pound but the
time hee remembreth not, And otherwise hee cannot depose.
To the fourth hee saith that the tobaccoes arlate were delivered out
of the warehouses at Portsmouth to the use of the said Wainewright
and Jefferies, but the time hee remembreth not, not having
here his bookes and notes whereby to informe his memory, and
saith they were taken into the possession of Mr Burton
(by them appointed to receive them) from this deponent, And
otherwise cannot depose.
To the 5 hee saith that the said tobaccoes could not be nor were
delivered out but with the permission and privitie of the
officers of the Customes at Portsmouth, for hee saith they had
locke on the warehouses wherein they were put and laid, and
saith that Cullerton of the Customes there declared and acknowledged
(as this deponent remembreth_ himselfe satisfied for the said customes when the said deliverie
was soe made, which hee knoweth for the reasons aforesaid,
And otherwise hee cannot depose.
To the 6th hee saith that by common usage and custome in this
place and parts arlate, tobaccoes are not delivered out of the
warehouses wherein the same are laid and whereof the officers
of the customes have keyes, untill the customes for the same be
paid, or satisfied and being delivered, the customes are commonly reputed
to be paid or satisfied, which hee knoweth being a merchant, and having
bin an officer for the state for prize goods. And otherwise
hee cannot depose.
To the 7th hee saith that neither this deponent nor, as hee
beeleeveth any officer or Commissioner for prize goods was privie
or consenting to any such seizure as is arlate, nor had any
notice that any such seizure was intended, And otherwise
hee cannot depose.
To the 8th hee saith hee cannot depose.
To the 9th nad 10th hee saith that the said Mr urton
imployed on the behalfe of the said Wainewright and Jefferies
for the receipt of the said tobaccoes, did not upon the receipt
thereof finde any fault ot take any exceptions at the
consition thereof, but received the same as well conditioned
which hee knoweth because hee this deponent delivered the
same, And otherwise hee cannot depose.
To the 11th hee saith that the Commissioners for prize goods
nor their officers were not nor gave any cause or occasion (soe
farr as hee knoweth or beleeveth) of any dammage whatsoever
to the said tobaccoes) And otherwise hee cannot depose
