William Maples is Master) against Thomas}
Broderick and Roger hatton the Owners of the sayd}
shipp and all others coming in and appearing on}

Examined upon a libell given in on the
behalfe of the sayd Peter Bartlett and others

James Salmon of Lymehouse in the parish
of Stepney and County of Middlesex Mariner
Gunners mate of the sayd shipp the Thomas
and Lucy aged 21 yeares or thereabouts
a witnes sworne and examined saith and
deposeth as followeth videlicet./

To the first article of the sayd libell hee saith and deposeth that the arlate Thpmas
Broderick and Roger hatton during the moneths of May June July August September
October November and december last past were Comonly and generally reputed and accompted to
be the true and lawfull Owners and proprietors of the arlate Shipp the Thomas and Lucie and hee hath heard the sayd Broderick acknowledge that hee and the sayd Hatton were Owners thereof the sayd tyme
and saith that during all the sayd tyme the arlate William Maples was Master and
Commander of her and did take upon him the government and Command of the sayd
shipp as Master thereof and as hee hath heard and beleeveth hee was
soe made Master of her by the sayd Broderick and hatton the premisses hee
deposeth being Gunners Mate and on board the sayd shipp during the whole voyage in
question And further saving his subsequent deposition hee cannot depose./

To the second article and schedule therein mentioned hee saith that hee this deponent
was by the arlate William Maples as Master of the sayd shipp Thomas and Lucy
hired in the moneth of May last past at the rate of forty shillings
a moneth to serve in the sayd shipp Thomas and Lucy in the voyage with her to
be made from the port of London to Newfound land to take in ffish and therewith
to sayle to Naples and from thence to Lepro to lade fruite and soe returne
for England (being the voyage now in question) And saith hee well knoweth that
the arlate Peter Bartlet and William hamblin, and the rest of the mariners
mentioned in the schedule arlate did alsoe serve in the sayd shipp the voyage in
question which began from Gravesend about the beginning of June last at which
tyme the sayd shipps company was to enter (and did enter into whole pay) and as hee hath heard the
sayd William Maples confesse and saye were all of them hyred by him in the
moneth of May last to goe the sayd voyage but what
wages hee contracted to give every of them hee knoweth not, not being
privie to the contract ade touching the hyreing of any but himselfe this deponent
The premisses hee deposeth for the reasons abovesayd and further hee cannot depose
saving hee saith that the sayd shipps company continued every of them sixe moneths
and a halfe at the least in service in the sayd shipp the voyage in question./

To the third 4th 5th sixth and seaventh articles of the sayd libell hee saith that the
arlate Peter Bartlet, William hamblyn, this deponent and the rest of the Mariners
of the shipp Thomas and Lucie did upon the 10th day of June last past at
Gravesend enter into whole pay, and then sett sayle from thense and arrived
safely at Newfound land arlate and there tooke in their ladeing of ffish and
by the order and comand of the arlate William Maples did sett sayle from thence
with their sayd ladeing of ffish towards Naples but in their course thitherwards
mett with a very violent storme which forced them for the preservation of
the sayd shipp and goods and their owne lives to cut their mayne mast by the
board
