to this Interrogatorie, then what hee hath formerly deposed

Examined upon the said Allegation:

Joseph Carswell junior of Limehouse in the parish
of Stepney and Countie of Middlesex Mariner : aged 18:
yeares or thereabouts a Wittnesse sworne and examined
saith and deposeth as followeth videlicet:

To the first Article of the said Allegation hee saith and deposeth, That hee
well knoweth the arlate Thomas Browne, and saw and observed him to be
Master of the shipp the John the Voyage in Controversie at Porta Port,
and never did see or observe him to be Master thereof before And further
or otherwise cannot depose:-/

To te 11th and 12th hee saith, That this deponent being Purser of and aboard the
shipp the Porto Port Merchant of this City at such time as the shipp the
John in Controversy was at Porto Port aforesaid laden and bound )as
there generally reported) for the Barbadoes well observed that the said shipp
John after such her lading descended from Porto Port to the barr of that
place, being designed to passe over the same and to proceed upon her Voyage,
but saith shee did there abide about a moneth after before shee could with
security passe the said barr, shee being a french built shipp and heavy and drawing
of the observation of this deponent and sewerall others, and according to his best
Judgement at least thirteen foot water, And saith this deponent going seweall times
upon occasions towards the barr, which the said shipp John lay ready to passe
observed three swerall times that her anchors were on board her, and shee
readie to passe the said barr, bu the winde coming in full from sea, shee
was still necessitated there to remaine, and that without any defect of the
said shipp, or neglect in her Master and Companie as hee verily beleeveth.
And further cannot depose./

To the 13. and 14th hee saith, That hee this deponent hath been 4 sewerall
voyages at Porto Port aforesaid, and thereby well knoweth, That there is
a very dangerous barr neere unto that place, which no forraigne shipps
doe or are permitted usually to saile over without the Conduct of Certaine
Pilots residing in Porto Port and commonly knowne by the name of the
kings Pilots, being thereunto authorized by order of the king of Portugall
and are there generally observed to bee the persons who doe and ought
to dtermine of the convenience of wind and water for the Conducting
of shipps of all sorts of burthens over the said barr, and have their
