And other wise hee cannot depose./

To the 4th hee saith the shipp the John remained, as hee remembreth
about 3. or 4. weekes after shee was laden in the harbour of Porto Port., and
otherwise saving his foregoeing deposition hee cannot depose./

To the 5th hee saith hee knew the Master of the shipp John interrate during [?and]
being at Porta Port the voyage in Controversy, but had no acquaintance with
the Mariners thereof, And further cannot depose forasmuch as hee was
never on board the said shipp John, nor ever heard any thing of a Protest
made against the said master and Companie upon the occasion interrate And further
cannot depose/

To the 6th hee saith hee knoweth not any of the Pylotts interrate by their
names, nor how many they are, nor ever observed any marke or badge for
distinction amongst them. And further cannot depose.

To the 7th hee saith hee cannot depose further or otherwise then by him
is predeposed

Examined upon the said Allegation:-/

Simon Orchard of Limehouse in the parish of
Stepney and County of Middlesex Mariner aged 26.
yeares or thereabouts a Wittnesse sworne and examined

To the first article of the said Allegation hee saith and deposeth, That hee this deponent
first saw and came acquainted with the arlate Thomas Browne at Porta
Port in Portugall in or about the moneth of Januarie 1653. English style
where this deponent saw and observed the said Thomas Browne to be Master and
Commannder of the shipp the John in Controversie, And further to
this article hee cannot depose./

To the 11. and 12th articles of the said Allegation hee saith and deposeth, That this
deponent saw and observed the shipp the John allate (Thomas Browne Master)
taking in of her lading of salt and other merchandizes at Porta Port
in or about the moneths of ffebruary of March last past, being
designed, as this deponent then and there was informed to proceede with the
same to the Barbadoes, And saith that after the said shipp was laded
at Porta Port as aforesaid, shee departed thencetowards the barr of
Porta Port and there continued for about 3. or 4. weekes (as this deponent
now remembreth) before shee could passe the said barr with safetie, And
saith, That to the best of this deponents judgement the said shipp John was
of the burthen of about 120. tunns, and drew full thirteen foot [?XXX]
being fully laden, and in that condition cannot saile with lesse water,
The premisses hee deposeth, for that this deponent was Masters
Mate of and aboard the shipp the Porta Port Merchant [?XXXX]
