To the third hee saith hee well knoweth the shipp the John of Weymouth Interrogated and hath knowne her
for these 8 yeares last past and saith by reason hee this deponent was on board her
before the sayd 20th day of december 1653 and before shee was as is predeposed carried
over the barr of Weymouth Roade hee knoweth shee was before such her goeing over
the barr, at least at or before the sayd 20th day of december 1653 fitted and provided
to have sett syale then from the Port of Waymouth if shee had not bin hindered by
the sayd presse, which caused her company to be absent themselves from on board her,
And hee saith hee cannot write nor kepyt any Accompt how the windes
stood the tyme Interrogated but well knoweth for the reson as aforesayd and sawe that the sayd shipp the John was
manned and victualed and fitt to proceede on her intended voyage from the Port of
Weymouth before the sayd 20th of december had shee not bin hindered by the meanes
aforesayd And further hee cannot answere
To the 4th hee saith hee knoweth not the names of any of the sayd shipp the Johns
Company, but Thomas Browne and one John Bebber the boatswaine of her, but
knew them all by sight hee this deponent living at Weymouth and seeing them almost dayly
during their staye there and knowing they belonged to the sayd John of Weymouth
And further saving his foregoeing deposition hee cannot answere saving hee saith
hee hath at sewerall tymes seene them all on board the sayd shipp, but not all on board
her at once And saving hee saith hee hath heard and beleeveth that the sayd shipps
Company were hyred to serve in her by the producent Captaine Arthur/
To the 5th Interrogatorie hee answereth negatively videlicet that hee is verily perswaded
the shipp the John could not upon the 20th of december 1653 nor at any tyme
after till about the 19th of January next after have found an opportunity to get out
of the harbour of Weymouth norr have escaped thence and avoided the ffrigotts
that laye there in the service of this Commonwealth./
To the 6th hee saith hee knoweth nothing of the contents thereo, and therefore
cannot answere thereto/

Godolphin doctor of Lawes one of the Judges of the
high Court of Admiralty of England saith and declareth
by Vertue of his Oath as followeth videlicet:-
That upon or about the 20th day of November 1654 last past, a shipp
or friggat being a man of Warr of Ostend and called the Saint Anne of
that place, being under the Command of Jacob ffernando a dunkirker haveing
mett withall and surprized at Sea a cetayne french Vessell belonging
to and bound for the Port of Saint Malo with her ladeing of fish and Trayne
then aboard her, the said Jacob ffernando with his said man of
warr and the said Prize were by distresse of weather forced into the
Port and Pee[?re] of the Island of Guerezey, where they now
