knowledge that the said shipp did goe out upon the sayd voyage in
the moneth of May 1653. But whether there were att that tyme
any Ambassadors there in England upon a treaty of peace to be had
betwixt England and holland he doth not att present remember
but he well remembreth that att that tyme there wes much talke
and great hopes of a Peace soone after to ensue betwixt the
sayd two Commonwealths, and further he cannot depose.

To the 2. article of the sayd allegation he saith, the said Pibus did goe forth
upon the sayd voyage upon a fishing designe to Graenland to return
to this Port of London, in the employment of certayne merchants and
was obliged to have a certayne number of men to attend and prosequat (sic)
that designe, and he had the sayd number agreed on, and now more
and the sayd Pibus had noe Commission or Letters of marque for the
seizing of any shippes or goods the sayd voyage; All which hee
knoweth to be ture being masters mate in and aboard the sayd shipp
that voyage, and going to and well acquainted with the sayd fishing
designe. And otherwise he cannot depose.

To the 3d article of the sayd allegation This deponent saith that, whilest the
sayd shipp the Martha did continue att Graenland the sayd tyme and
voyage, and long before, the dutch built vessell in question was mett
with, there was in and about the English fishing place at Greenland
a fame and report that an absolute peace was made and accorded by
and betweene the sayd two Republiques of England and the United
Provinces, which report came from some of the Dutch shallopps
which some of the English had mett with and had discourse with
some of the Dutch men in the sayd shallops. And further saith
that in the Passage of the Martha for London she mett with
severall fishermen att sea, and they of this deponents hearing
did confidently relate it as a certayne truth that the sayd peace
was firmely and finally concluded, And this deponent and others
of the Marthas Company did hope and beleive that the sayd report
was true, And further or otherwise he cannot depose.

To the fourth article of the sayd allegation This deponents aith that the sayd
dutch=built vessell which was mett withall by the sayd Pibus this deponent
and Company in their Returne from Graenland was mett off off
Shottland whither by reason of the wind it was not then possible for the
Martha to goe, And it was upwards of two hundred leagues from
England, And the sayd Pibus this oponent and Company did not
fight with or against the sayd dutch built shipp, but onely called to her
for newes by shooting two or three gunnes at randon (sic) after the manner
