to the [Xonerment] thereof and hath taken the Ingagement as is arlate
And saith that by [XoXn] on [wpate] the sayd Dominick Martin was borne
in Galloway aforesaid. And further he cannot depose

To the second article of the sayd Allegation This deponent saith, that in the
monethes of October november december and January [16X2] and before and fine the sayd
Dominick Martin did by his facto Thomas Martin this deponents [?personage]
in this [?imso] drive a hade in the way of [mXXshandifXm] from Galloway
and also parts to Cadiz and [] in Spaine for for money plate and
sylver, the reason of this deponents knowledge in the [p...XXXeX] is that he
this deponent being att Amsterdam in the sayd yeare [16X2] and about
four or five monethes before the warr begann betwixt England and
Scotland did there see the sayd Dominick Martin and go [XXnn] this sayd Thoma[s]
Martin and the sayd dominick martin then [XeX] the sayd Thomas Martin from Amsterdam with a
Comission to be his facto in the sayd porte of Spain and sent along
with him a good quantity of Linnen Cloth and tanned hides of [yXeal]
value, and [?allowed] him to sell the same there and to make him returne
thereof as he should from tyme to tyme [newiXX] directions, and saith he
hath [] inedibly heard in Spaine and elsewhere that the sayd
Thomas Martin did in October [16X2] make returnes of the sayd linnen
and [hiXXy] upon his sayd fathers Accompt in plate sylver and moneyes
And otherwise cannot depose

To the third article of the sayd allegation This deponent saith that being about the
moneth of december last past att Bilboa in Spaine he this deponent
receyved a letter of [?Advise] from one Christopher Kirwan a [mevihan]
of Cadiz a Conesp anderl of this deponents in which letter it was
intimated to this deponent that sayd Thomas Martin in october
then [neXX] priding had for this sayd fathers Accompt laden severall
quantities of plate and moneyes att Cadiz [Xonfiyned] for ostend and
that the shipps whereon the same were laden in their Course for
ostend were seized by some of the shipps of this Comonwealth. And
saith that afterwards about the moneth of January [16X2] - this deponent
[XeXeyXed] att Bilboa aforesaid a [XXXe] of Aonise from the say Dominick Martin dated from
London, where it seemes he was att the writing thereof; in which letter the
sayd Dominick did testify by this deponent, that severall quantities of moneyes
and plate which his sonn had laden for his Accompt att Cadiz in the
sayd month of october 1652 was seized in the [pansaye] of the shipps
whereon it was taken to ostend, by the shipps of this Comonwealth for
which [] this deponent verily beleiveth that the sayd Thomas
Martin as ffacto for this sayd father and for his Accompt did in october
1652 lade aboard upon some shipps then layeing at Cadiz and bound
for ostend and [sinXX] taken by the shipps of this Comonwealth a quantity
of sylver plate and moneyes and farther he cannot depose

To the 4 5 6 7 and 8th articles of the sayd allegation he sayeth he cannot [?depose - obscured by smudge]

To the 9. he saith he well knoweth to him he witte [?Jasperson] and saith he
a native of Limerick in Ireland and otherwise cannot depose

To the 10th he saith he cannot depose

To the 11th he saith his deposition are free, and further he cannot depose
