of Antwerp was ant to this present is and ought to bee the true and
Lawful Owner and Proprietor of all and singular the pieces of eight
mentioned in the three schedules annexed to the said Allegation and now showne
to him this examinate and read over unto him in the Dutch toungue, And for
the lawful Proprietor thereof the said John Smeesters was and is commonly
reputed and taken videlicet of eight hundred pieces of eight contained in one
[LH FIRST MARK] bagg marked with the first marke in the margent mentioned in my first schedule and of eight
hundred pieces of eight contained in two baggs marked with the second
[LH SECOND MARK] marke in the margent, and mentioned in the second schedule annexed and
of eight hundred peeces of Peru Coyne contained in two baggs marked with
[LH THIRD MARK] the third marke in the margent and of eight hundred pieces of eight in
[LH FOURTH MARK} one bagg marked with the 4th marke in the margent, both the two last
parcells being expressed in the third schedule annexed. Which hee knoweth
for the reason by him hereafter expressed and otherwise cannot depose.

To the 2 & 3 hee saith That the said John Smeesters the partie
producent in this Cause for theise ten yeares last past or thereabouts of
this deponents certaine knowledge hath bin a Merchant driveing a Constant
trade to Cadiz Saint Lucar and other parts and places in Spaine for moneyes
and other goods wares and Merchandizes and had and hath his ffactors and
agents there residing for the management of his Merchandizing affaires, and
receiving the goods by him transmitted unto them, and sending him returnes
for the same in moneys and merchandizes, Which hee knoweth for that
the said producent for all the time predeposed hath held constant corres
pondence with this deponents ffather at Saint Lucar, by meanes whereof this deponent
is well acquainted with the manner of the said producents traffique and trade
And further saith that in or about the months and in the year 1652
predeposed Gerard Ryper and John Laucotte factors in the said producent
did trade at or near Cadiz in Spaine lade and putt on board the shipp the Sampson (Otto George Master)
all and singular the pieces of eight mentioned and expressed in the
first schedule annexed to the Allegation and marked with the first marke
in the margent and on board the Shipp Salvador (Christian
Clooppenburgh Master) all and singular the peeces of eight mentioned in
the said second schedule under the second marke before expressed, and
on board the shipp the Saint George (John Martine Coup[?] Master) all and
singular the pieces of eight mentioned and expressed in the third
schedule annexed and marked with the two last markes formerly also
expressed, all which silver was so by them laden to be transported and
carried in the said shipps from Cadiz to Ostend in fflanders and here
to be delivered to the said producent, or his Agents or [?] there
for his use and accounpt, which hee also knoweth for that this
