And accordingly in or about the moneths predeposed, and about the time of
the lading of the said severall parcells of silver plate and moneyes, this deponent
then being at Cadiz, and diverse times in Company with the said ffactors
and being himselfe bound for fflanders with the said shipps, the said ffactors
showed unto this deponent bills of ladeing for the said severall respective parcells
of silver and moneys predeposed, and their letters of advise and factories wherein they
declared their intention was to send the said bills over land to the said producent
to acquaint him with the said lading, and this deponent then also saw and
perused the bookes of accompts of the said ffactors wherein they had respectively
entred the said parcells conforme to the said bills of lading, and requested
this deponent at his arrivall at Antwerp to certifie so much unto the said
producent. And otherwise hee cannot depose:-/
To the 5:th article and schedules annexed hee saith and deposeth, That forasmuch as
this deponent at or about the time of lading predeposed was personally present at
Cadiz and saw severall of the subscriptions and firmes of the respective Vaptaines
predeposed, or of their Pursers for the receipt of the parcells of silver predeposed, and
for severall others, hee well observed ad knoweth their severall firmes, and in that
regard, and for the reasons predeposed, hee is fully and absolutely assured in Conscience
that the severall bills of lading annexed and now shewne unto him were and are
true and reall, and made according to the verity of the matter, and subscribed by the
severall Masters or of their Pursers at Cadiz according to the dates and contents
thereof. And otherwise saving his foregoing depositions hee saith hee cannot depose
To the 6:th hee saith hee hath no knowledge of the manner of the said producents
book keeping, but beleiveth that the said producent being a Merchant of extraordinary
great trade and Commerce, doeth, as to such a Merchant belongeth, keepe very
exact accompts according to the manner of Debitors and Creditors usuall amongst
Merchants. And further cannot depose:/
To the 7th hee saith that for the reasons by him predeposed hee is assured
that the said producent did and doeth beare the adventure of the silver and
moneyes predeposed, and was and is the true and sole Owner and Proprietor
thereof and that no other person Whatsoever hath any interest in the same
And otherwise saving his foregoing depositions hee saith hee cannot depose./:
To the 8:th hee saith, That the arlate John Bollart the producent is
a Subject of the King of Spaine, and all the ffactors predeposed are inhabitants
in Cadiz, and Subjects to his Catholique Majestie aforesaid between whom and
this Commonwealth there is peace and Amity:- And further cannot depose
To the 9:th hee saith, That the trade of silver is more privately ddriven by [?Merchants]
than any other trade for other goods or Merchandizes, and that theise [?parts] of the
Christian World are most supplied with silver from Spaine, to the great advantage
of trade wheresoever the same doeth come, and would certainly bee a very great
prejudice to Merchandize in case it were interrupted which hee knoweth [?being]
as aforesaid a Merchant driving the said trade for severall yeares last past
