to which hee referreth himselfe hee saith hee cannot depose saving that this
deponent not long since being at dunquirke and in discourse with Jaques
de Brower one of the Schepens orMagistrates there being the person nominated in the
bill of ladeing to receive the said silver, had declared to this deponent and his Contest, that
hee was to have received the same for the producents accompt and as his Correspondent
and no otherwise:/:-

Examined upon the said Allegation:-/

Antonio Lois of Antwerp in Brabant Merchant
aged thirty yeares or thereabouts a Wittnesse sworne
and examined saith and deposeth as followeth, videlicet./

To the first and second articles of the said Allegation he saith and deposeth, That for
theise 6. yeares past of this deponents knowledge and by Credible relation and
observation of bookes of accompts from 20. yeares last past and upwards the arlate
John Smeesters the producent hath bene and now is a Merchant and inhabitant of
Antwerp and a Subject of the king of Spaine, and hath driven and still driveth
a very great trade to Spaine for silver, having ghis factors and Correspondents there
for the management of his Merchandizeing affaires, receiving selling and disposing
of his goods for his accompt, and making of him returnes in silver plate bullion and
goods according to his orders and directions, And saith That the said producent in
the moneths of december January ffebruary and March last past 1652,. or some
of them was and now is the true and lawfull Owner and Proprietor of one bagg
of peeces of eight containeing foure hundred seaventy and five peeces of eight

marked with the marke in the margent and number 1. and of two barrills of sweet Lemons
and two barrells of Olives of the same marke, And for such the said producent
was and is accompted. Which hee knoweth for the reasons hereafter expressed
And otherwise cannot depose.

To the third 4. 5. and 6:th articles of the said Allegation and schedule annexed hee saith and deposeth.
That in the yeare and moneths predeposed or some of them Gerard Ryper one
of the ffactors or Agents of the said producent resideing at Cadiz in Spaine did
there lade and casue to bee laden aboard the shipp the Morning Starr arlate then lying
at or neare Cadiz for the said producents accompt the said bagg of 475. peeces of
eight marked as aforesaid, and one Michael Perry senior one of the said producents ffactors
did also then and there for the producents accompt lade or cause to be laden in the
said shipp the said two barrills of sweet Lemmons, and two barrills of olives of the
same marke to be transported in the said shipp (Michael van Lubkin Master) to
Dunquirke in fflanders and there to be delivered to the said producent, or Jaques de
Brower, who is his Correspondent there, for his accompt. And saith That shortly after
the lading of the said silver and goods this deponent saw and perused letters of
advise sent from the said ffactors to the said producent by the land poast from Spaine
together with the bills of lading annexed and now shewed unto him this examinate by
which letters and bills of lading the said ffactors respectively intimated unto the
said producent, That they had as afoesaid laden the silver and goods predeposed
