Transcription

To the first second and third articles of the said Allegation hee saith
and deposeth That hee this deponent well knoweth the arlate
Nicholas [?Budeveir] and hath soe done for the space of these
twenty yeares and upwards during all which tyme hee hath bin
and att present is a Merchant dwelling at Lisle in fflannders
and a subiect of the King of Spaine and a man who for all or the
greatest part of the said tyme hath driven and now doeth drive
a great and a constant trade to Mallaga Cadiz and other parts
in Spaine where hee hath his correspondents remaining
accordingly And saith that in or about the moneth of Aprill last
past there was att Cadiz laden and put on bord the said Shippe
the Saint John Evangelist whereof this deponent was and is Commander
at Cadiz the number as five hundred peeces of eight in one bag marked
as in the margent (and of which hee was and is comonly accompted the
true and undoubted Owner) to bee transported in the said ship
from Cadiz to Ostend or Dunquerke where the same was consigned
to bee delivered to the said Nicholas [?Budieere] or his assignes for
his propper Riscoe and accompt which hee knoweth because
hee this deponent being at the tyme predeposed Commander of the said
shippe did see the said plate laden thereupon under the markes
and for the accompt of the said Nicholas Bud[?evre] and sawe the same entred
into his precontests booke accordingly And further cannot depose.

To the fourth 5th and 6th articles of the said Allegation and to the schedule
annexed and now shewed unto him hee saith and deposeth that
upon the said Ladeing of the said five hundred peeces of eight on
board the said shippe hee this deponent did at Cadiz signe and
sett his hand to three severall bills of ladeing all of one Tenor
and date (and noe more) for the same one of which the factor by
whom the said peeces of eight were brought on bord delivered
to this deponent and the other two hee kept with him there,
And that hee saith the said ship sett saile with the said moneyes
on bord her for Ostend or Dunquircke and in her Course
thitherward was mett withall surprized and taken by Captaine
Cox in the Phenix frigott in the ymediate service of this comon wealth
att which tyme the said peeces of eight with the said bill of ladeing were
on bord her and came to the hands and possession of the said takers
thereof. And saith that the bill of ladeing annexed and now shewed unto
him was and is opne of the said three originall bills of ladeing which this deponent
soe signed at cadiz upon the ladeing of the said plate on bord the
said shippe, the contents whereof were and are true and were soe had and done
as therein is contayned to which hee referreth himselfe. And further cannot
depose, saveing that the said bill of ladeing annexed being since the
signeing
