The 7th day of March 1652 upon the allehgation given on the
behalfe of the Claymers et cetera
The Clayme of Anthony Rodriques of Cadiz}
of Spayne for twelve Potaccoes of Tobaccho marked}
with the first marke in the Margant and likewise of}
ffrancis Markadoe for fower Potacchoes of Tobacchoe}
of the second marke and countermarked with the third}
marke in the Margent Laden aboard the Shipp the}
Sampson whereof Octavio George is Master [?XXXed] by}
certayne of the States Shipps}

in the West Indye Merchant aged about
34 yeares a witness sworne and examyned
in this Cause deposeth as followeth
To the first article of the said allegation he sayeth and deposeth That he hath well knowne the arlate
Anthony Rodriques and ffrancis Machado for theis sixe yeares last past or thereabouts
dureinge which time the forsaid Roderigies hath lived att Cadiz and ffrancis Machado
hath lived commonly att Port Saint Mary neare Cadiz and have there maniteyned theire
wifes and ffamilyes [?and] [?hee] sayeth That about the moneth of May last
past the forenamed Rodriguez and Macado beinge then att the Port of
[?Marcaraco] in the West India did come with him this deponent in the Shipp called
Nostra Seignora del Rosario to Cadiz in Spayne where they arrived about the
moneth of September last but sayeth that the said Anthony
Roderigues and ffrancis Machado arlate for theire perticuler and respective Accompts
in or about the moneth of October 1652 arlate did cause to be laden aboard the shipp
the Sampson arlate lyeinge att or neere Cadiz in Spayne twelve Pattachoes
tobacchoe of the second and third marke in the margent which were to have beene from
thence transported in the said Shipp the Sampson to Oastend (sic) which hee knoweth to be
true for that hee this deponent sawe the said Tobacchoes laden at Cadiz afforesaid aboard
the said Shipp wherein the forenamed Roderigues and Machadoe came as passengers
from Spayne for Oastend And further to this article saveinge his subsequent depositions
hee cannot depose saveinge that the said Roderigues and ffrancis Marchado were and are
reputed and commonly accompted Lawfull owners and Proprietors of the said Tobacchoes
To the second article hee sayeth and deposeth That within the tyme predeposed hee was present
att Cadiz afforesaid when the arlate Octavio George Master or Comannder of the Sampson
arlate did signe the originall Bill of Ladeinge arlate uppon the lading of the Tobacchoes
predeposed which hee sayeth with twoe others besides the Bill of Ladeing arlate
was signed as afforesaid before the said Shipps departure from Cadiz uppon the voyage
predeposed andfurther cannot depose
To the 3d article hee sayeth and deposeth That for all the tyme predeposed The forenamed
Anthonie Roderigues and ffrancis Macchadoe were and yett are commonly reputed natives
of the Kingdome of Spayne and subiects of hs Catholique Maiesty And further hee cannot
depose saveinge That in the said shipp the Sampsons course from Cadiz to Oastend (sic) arlate
comeing through the English Channell the said Octavio George was commanded by some of
the Parliament of Englands ffleete to come into the downes which hee knoweth ffor that
hee this deponent being aboard an other Shipp called the Salvador which came in
company with the Sampson predeposed from Cadiz was likewise stayed and commannded by the said
[?man] of warr to come into the downes with the said shipp the Samposn
