Transcription
Ile of Wight, which the said ffletcher accordingly and by vertue
thereof had free ingresse and egresse to the said shipp, And hee saith that while
after the said ffletcher went upp to London, and returned within a little space
and came into the said shipp and was taken and reputed as master thereof
And therein and therewith sailed into Poland, But hee saith that hee
never was, nor was ever accompted any Owner or Prroprietor of any
part of the said shipp the Constant alias the ffredricke
and William for ought this deponent knoweth or hath ever heard
the premisses hee deposeth for that hee was privie to the conference aforesaid
And went in the said shipp and was left in Poland from whence he
was sent as aforesaid And further hee saith hee cannot depose.
To the Interrogatories [CENTRE HEADING]
To the first he saith that hee cometh to bee a wittnes in this cause
att the request of the producent Mr Stephens, And saith hee hath
a quarter part in the shipp the ffredericke and william which hee hath
sett over to the producent for his securitie in respect hee became Baile
to answare the Actions for which the said shipp was arrested, And saith he
hath knowne the producent Mr Stephens 7 yeares last or thereabouts
And further hee answareth negatively.
To the second hee saith that hee hath knowne the shipp interrogated formerly
called the ffredericke and william and now the Constant (as hee heareth she
is now called) ever since shee was built which was about 14 yeares agoe
And that hee knoweth the interrogated John ffletcher, and saith hee was putt master thereof
by the producent about 6 yeares since, and so contynued master thereof in the voyage to
Poland which was about 6 weekes, since which time hee hath neither seene the
said ffletcher nor the said shipp con[XXXXXXXX] And [?otherwise] saveing his
foregoeing depositions to which hee referreth himself hee knoweth not./
To the third hee saith hee cannot answare to any part thereof
To the fourth hee saith that hee hath no Judgment in the worth of a shipp
hee being no Seaman, and saveing his former depositions hee
cannot depose./
To the 5th hee saith that this deponent assigned and sett over his quarter
part of the said shipp unto the producent by a deed of bargaine and sale
about six yeares since for the considerations aforesaid And that one Squire
Thomas was baile with the said Mr Stephens to the Actions against the said
Shipp, And that Mr Steevens was possessed thereof by vertue of the said sale
and hee beleeveth that hee hath disbursed divers summes of money in this
suite and in defense of the Actions aforesaid And otherwise saveing his
foresaid depositions to which hee referreth himself hee saith hee cannot
answare or depose.
