The Claime of Geo: Scutt}
the elder George Scutt and}
Company for the shipp the}
Jane and Elizabeth of Poole}
and the tackle furniture and}
apparell and lading of ffish}
in the same taken by a Jersey}
man of warr and carried into}
Jersey}

Examined upon an Allegation given in on the behalf
of the said Scutt and Company/

Edward Norris of Poole in the County of dorsett
Marriner aged 32 yeares or thereabouts a wiyttnes
sworne and Examined deposeth as afolloweth./

To the first article of the said allegation hee saith and
deposeth that for and dureing the time arlate the said George
Scutt the Elder George Scutt and Company were att and att this present
ought to bee the true and lawfull Owners, and Proprietors of the shipp the

Jane and Elizabeth of Poole arlate, and of her tackle apparell and furniture
And were and are comonly accompted and knowne to bee, whichj hee knoweth
for that hee this deponent was and went out in the said shipp one of her Company and was
quarter Master thereof And further hee cannot depose saveing hee so contyvnued
quartereur of and in the said shipp untill she was taken and seised as hereafter
is expressed./

To the 2d article of the said allegation he saith and deposeth that when the
[?time] arlate the said George Scutt the Elder George Scutt and Company did
send out and imploy the said shipp the Jane and Elizabeth arlate from the Port of
Poole arlate on a fishing voyage to Newfound Land And so to returne againe
for England, And hee saith that the said shipp did accordingly safely arrive att
Newfound land And there tooke in her lading of fish and oyle for the use and
Accompt of the said George Scutt the Elder, George Scutt and Company aforesaid
which hee deposeth for that hee went out in the said shipp as Quarter Master thereof and
returneing for England from Newfound land was seised as hereafter is sett downe
to which hee referreth himself and further hee saith hee cannot depose

To the third article hee saith that about Michaelmas last past and within
the time arlate, And after such time as the said shipp the Jane and Elizabeth had received
in her lading of ffish and oyle att Newfound land, as aforesaid she did sett saile
therewith (being bound for Poole aforesaid) And in her passage thither was
mett with by a Jersey man of warr and shee and her lading surprized taken and
carried into Jersey where she now remaineth, And hee this deponent and the rest of
the shipps Company were taken out of the said shipp the Jane and Elizabeth and
some sett on shore in one place and some in an other And further giveing his
reasons of his knowledge thereof as aforesaid hee saith hee cannot depose

To the fourth and fift{h} articles of the said allegation hee saith and deposeth That
att such time as the said shipp the Jane and Elizabeth did sett saile from Poole to
Newfound Land as aforesaid, And att such time as shee was surprized and taken
as aforesaid and Carried into Jersey the arlate Peter Baker was Master and Comander
of the said shipp and as Master had the Comand and care thereof, And was soe accounted
reputed and knowne to bee, And he further saith that the said Baker is now att
Jersey and hath certefied from thence unto the said George Scutt the elder Georg[?e]
Scutt and some of the Company (now returned) by letters or otherwise that the said shipp the
Jane and Elizabeth and her lading so by them lost as aforesaid and carried
unto Jersey is there nowe remaineing, which hee deposeth for that hee hath spoken
with divers marriners and others who were att Jersey, and did speake with the said
Baker there, who tould this deponent that the said shipp and lading was there as aforesaid
And further hee cannot depose./
