The 28th of October 1651
On the behalf of Nicholas}
Bond Ysquire touching his losses}
at Lisbone}
Rp.
Nicholas Bond of the parish of the Savoy Esquire aged
44 yeares or thereabouts sworne before the right worshipfull
John Exton doctor of lawes one of the Judges of the high
Court of the Admiraltie saith and deposeth.
That this deponent sent to Lisbone all and singular the goods and
merchandizes mentioned and expressed in the first leafe of the account
hereunto annexed, amounting to the severall summes therein specified, and
that hee hath only received for the retournes thereof those mentioned
in the second leafe of the said schedule or accompt, which said [?accompy GUTTER]
(as by letter of advice by him received from John Ba[XXXX GUTTER]
his factor there appeares) was and is true both in the summes and particulars
therein expressed. to the best of this deponents knowledge and as
hee verily beleeveth.

Examined on the allegation given in on the behalfe
of the said Batt.

Peter Stoner of London merchant aged 48 yeares or
thereabouts a wittness sworne and Examined deposeth as followeth
To the first hee saith and deposeth that in the voyage in question
he this deponent did goe as ffactor or Supra Cargo for the
arlate Thomas Batt in the said shipp the Elizabeth and [XXX GUTTER]
arlate And had power to direct the said shipp to such places as hee should
thinke convenient and there to trade for and on the behalf of the said
Batt, and was dureing all the said vopyage so accompted and affirmed
and had such power as aforesaid And further hee cannot depose.
To the 2d article of the said allegation hee referreth himself to the
Charter partie mentioned therein And otherwise hee cannot depose
To the third hee saith and deposeth that in the monthes of
december and January in the yeare 1644 hee this deponent
being ffactor as aforesaid intending to trade at Tetuan in Barbary
arlate did order that the said shipp should bee sailed thither where she
safely arrived within the time aforesaid, and there hee saith hee went
on shore to trade and traffique, and directed and appointed
the said Thomas Middleton to anchor or ride with the said shipp nere there
unto, that such goods aboard the shipp as hee should sell or barter
bee unladen, and that the markett might bee made use for the best advantage
of the said Batt [XXXX] voyage And otherwise hee knoweth not./
To the Fourth and fifth hee saith That he this deponent being att Tituan [XXX GUTTER]
[XXX] said shipp which was laden for the next p[?ort] with a Cargazon of
Tobaccos, The which att that time was a vendible Comoditie in that [?place GUTTER]
had some treaties with the merchants at that place who had both money[?es GUTTER]
wax and hydes (as they did offer) in payment or barter for the said [?Tpobaccoes GUTTER]
and other goods which hee had to dispose of in the said shipp at Tituan
And hee further saith that dureing the said Treatie betweene this deponent
and merchants hee the said Thomas Middleton in the night time [?and GUTTER]
without the order and direction and without the consent and knowledge of
this deponent did saile out of the Roade of Tituan and went out of the [XXXX GUTTER]
