12th May 1638

John Carter of the parish of Christ Church London Apothecary aged
about 24 yeares sworne before the worshipfull William Sames doctor of
Lawes Surrogate to the right worshipfull Sir Henry Marten knighte Judge of
his Majestyes High Court of Admiraltye sayeth and deposeth uppon his
oath as folowes videlicet

the sayd shipp in her passage from
London towards Virgiia with all and singular the goods expressed in the
sayd schedule and other her ladinge abord her was surprized and
taken by the Spanish fleet whereof the Marques of Cardinesa was
Generall in the moneth of September last past neere the coast
of the Barmoodas, and by them carryed into Cadiz in Spayne, and
there the sayd shipp and goods doe yet remayne as he beleiveth who
was in the sayd shipp at the tyme of her takinge, and was caryed in
the Vice asmirall of the sayd Spanish ffleet to Cadiz aforesayd And
this he affirmeth uppon his oath to be true

Ad primum arlum allons ex parte Sandwell dat nescit deponere./

Ad 2um arlum allons pred dicit et deponit That upon Thursdaye the
26th day of Aprill ast past the shipp called the John of Ipswich
(whereof Beniamyn Harrison is master) about six or seaven of the clock
in the morninge, came to anchor in the river of Thames neere the
ould stayres in Wappinge, and in the afternoon of the same day
the arlate shipp called the Dorcas of Ipswich (whereof Mr Sandwell
the producent is master) came up into the sayd river and came
to anchor and was moored neere the sterne of the sayd shipp
the John in a convenient place where shipps doe usually ride
and both the anchors by which the sayd shipp the Dorcas was moored
were sufficientlye buoyed with twp buoyes which of this deponents
sighte did beare in the strength of the tyde,
