Ad 5um affirmat That it is impossible for a shipp that is to goe to the
East Indies to convey any letters or bills of Exchange from thence to the
porte of London every six monethes for that in the East Indies the windes doe
blowe by the space of six monethes Easterley and the next
six monethes westerly constantly soe that shipps can come from
thence not above once a yeare which he knoweth to be true for that he went comander of a shipp Et alr nescit deponere.

Ad 13um nescit deponere

Ad 14um affirmat That he well knewe the shipp the Samaritan in question
and that as he guesseth the sayd shipp was of the burthen of three hundred tonnes
or thereabouts, and in his iudgement a shipp of that burthen is worth
for the fraighte thereof to the East Indies one hundred and fiftie or one hundred and sixtie pounds
per moneth only for the weare and teare of the shipp tackle furniture
and munition

Ad primum rendet That he favoreth the partyes in this cause equallye
and desireth that right may take place Et alr rendet negative/

Ad 2um rendet That Mr Wannerton requested and procured this rendent
to come to testifye and declare his opinin unto certaine articles
which were given in this Court and cause which should be showed to him
(as the sayd Wannerton afirmed) when he came to be examined, but
the sayd Wannerton did not tell him to what effecte or purpose he should
be examined (to his remembrance) savinge he sayeth he tould him that it
was concerninge the shipp the Samaritan, and that Captaine Hull and Captayne
Headland hath bene alreadye examined uppon the same busines Et alr
nescit rendere./
