To the 10th. hee answereth That hee beleiveth the
same to bee true/
To the 11th. hee answereth and beleiveth, That
a coppy of the notariall contract or Charter party which hee
sent over to the said Owners was in the Portugall language
and was a true coppy of the said affreightment for the said voyadge
as hee beleiveth to which hee doth referre himselfe, but the
schedule annexed being in English hee doth not knowe
whether it bee truely translated or doth agree with the
originall contract or not
To the 12th. and 14th. hee answereth and beleiveth That
hee hath not made any account, to the said owners or
any of them, for the said average, nor doth conceave
they have any right to the same, or any thing, to doe
therewith./ but doth beleive the said average
is an allowance peculiarly belonging to
the Master and Company and was in this
cause to bee not onely an encouragement
to them to fight and defend the goods, if
occasion required, but to undergoe the great
hazards and dangers of their lives, by the
great intemperature of the Rayne and
the excessive heate of the countrey whereby
many contagious diseases were contracted
and divers of them dyed and hee this
respondent had a very dangerous sicknes
in the said voyadge for divers weekes
which cost him one hundred pounds and
upwards all which was defrayed out of
the said average, and there were severall
abatements made, as a roove upon a
chest
