the Judges et cetera/

The personall answers of the worshipfull
William Stepens doctor of lawes and one of
the Judges of the high court of Admiralty
made to the pretensed positions of a pretensed
Libell given and admiitted on the behalfe
of Robert Bagnall as followeth.

To the first he answereth and beleeveth that within
the time arlate hee this rendent was in the
quiet and peaceable possession of the said ship
and the arlate John ffletcher and this rendent
had treaty and conference to togeather concerning
teh said ffletcher his goeinge as master of
teh said ship the Constant formely called the
William and ffredericke to saile and navigate
the said ship meerly as a servant and not otherwise and hee this rendent did
condescend and agree that the said fletcher
should goe as master of the said ship, provided
hee would bring sureties to be engaged and
be bound, for his honest faithfull behaviour
dureinge the time of his trust as master in
the said ship, which as this rendent beleiveth the said ffletcher did
promise and undertake to doe, and by
reason of the [?XXX] agreement between this
rendent, and the said ffletcher, hee the
said ffletcher had free accesse, egresse and
regresse in and out of the said ship, all things
being performed but only the said ffetchers
giveinge the said security, which this rendent
daily expected to have, But the said
ffletcher tooke the oportunity of the said
freedome, and went away with the said
ship as msater thereof from this Port
