depositing into the hands of the Marshall the remainder of his proportion

the presence of Samuel howe Notary publique
Appeared the said Budd for the said
Thompson and company and made himselfe
party for them at whose petition the Judges did
decree all and singular that will take upon them
the defence and justification of the seizure of the
said shipp and ladinge to be cited [?vijs] et modus et cetera
to appeare in this place upon wednesday the 12th of
this month in the morning betweene nine and twelve to
see an allegation given and admitted and witnesses produced and
sworne thereupon with intimation et cetera and a letter to be
written to the Ambassador for the king of Spaine to signifie
the premisses unto him./.

Notary publique Appeared the said Budd
and alleadged that the said Bourcher hath
bought severall goods of the Commissioners for prize
goods and that he doth refuse to pay for the same
according to the contract made betweene him and the
said Commissioners for the same and thereupon the Judges
did decree the said Boucher to be monished to appeare
upon Satterday next in this place in the morninge to
pay the value of the said goods according to their contract
and agreement in that behalfe made or to shew cause why he
should not be compelled to pay the same./.
