were throwne over board for the necessary preservation of the shipp the
Gilbert and her Company and passengers lives and her ladeing And saith there
was a great quantity of fustick wood, and some sugars belonging to
other Merchants besides the sayd bellinger alsoe throwne over board for
the like reason but the quantitie or to whome by name they belonged hee
knoweth not And further hee cannot answere/:

Jacob Ceelay of Wapping in the parish of Stepney and County
of Middlesex Mariner aged fiftie six yeares or thereabouts
a wittnesse sworne and examined saith and deposeth
as followeth/

To the 1: 2: 3: 4th and 5th articles of the sayd allegation hee saith that
hee this deponent was one of the Company of the arlate shipp the
Gilbert the whole voyage in question and thereby knoweth that while
shee remayned at the Barbados the sayd voyage and after shee had
taken in her full ladeing there the sayd arlate Beniamin Bellinger
sent eight hogsheads of sugar marked as in the margent to be
transported in her thence to England and the same being come to the
shipp side it laye there two dayes or thereabouts for that the arlate
William Croford and Company did refuse to take it aboard by reason
they knewe their shipp to be full laden and the hold full and the tatches
layed and the shipp soe full that they were forcedd to
stowe some sugars and other goods betweene decks and to stowe their
water and other provisions and some fustick betweene decks And saith that after the
same had soe layne by the shipps side about two dayes the sayd
Beniamin Bollinger came him selfe aboard and spake to the sayd
shipps Company and asked them why his sayd eight hogsheads of
sugar were not taken aboard and this dependent and divers others of the
shipps Company snwered and told him that there was noe roome
in the shipp conveniently to stowe them and therefore they could not take them in
whereupon the sayd Bellinger desyred to speake with their Captaine
the sayd Croford who was called and being come the sayd Bollinger
