Transcription

1. To the first and second articles of the sayd allegation he
2. deposeth and saith That of his his this deponents certaine
3. knowledge (who went out Purser of the arlate shipp the
4. Edward and John in her voyage from this Port of London
5. to the Barbadooes and soe home againe) their was shipped
6. and putt aboard the sayd shipp an iron=gray gelding to
7. be transported from this port of London to the Barbadoes
8. and there to be delivered to the arlate Major Chamberlaine GUTTER
9. or his Assignes ˹(as did appear by a bill of lading which this deponent hath seene)˺ and that the said horse was safely
10. transported to the Barbadoes, and there carryed ashore
11. by the arlate henry Turpin, And that the sayd
12. Gelding or horse being not delivered there to the sayd Major
13. Chamberlaine, he the sayd Chamberlain did commence
14. an action or suite against the producent, And he
15. deposeth that he the deponent was brought to a tryall, and
16. that in all probability Captain Totty had overthrownX GUTTER
17. the sayd major Chamberlain in his said suite for
18. the sayd Gelding, had not the said henry Turpin
19. then in publique Court acknowledged to the JudgeX GUTTER
20. that it was good reason that he should pay his share
21. and the rest of the shipps company their severall and GUTTER
22. respective shares out of their wages for the value of the
23. sayd Gelding; The premisses he deposeth being Purser
24. of the sayd shipp as well the ˹her˺ outward as homeward bound
25. voyage, and present in Court at the passages by him
26. predeposed And further he cannot depose,/

27. To the third article he deposeth and saith that he this deponent
28. being Purser of the shipp arlate for the voyage arlate
29. did therby well understand that the goods arlate
30. were putt on board and shipped to be transported to
31. the barbadoes and there to be delivered unto or for
32. the accompt of the severall persons arlate , he the
33. deponent having seene the severall bills of lading
34. for the said goods, And he saith that the said goods were GUTTER
35. ˹not delivered˺ embezled but have XX by whose ˹default˺ he knoweth not, And
36. the sayd Captaine ˹Totty˺ the producent was at the Barbadoes GUTTER
37. (of this deponents certaine knowledge) sued for and
38. condemned in the sayd respective goods wXXXs and XXXXX GUTTER
39. arlate with expenses of suite XXXXX in two sheets of XXXX GUTTER
40. and sixty deale boards for the accompt of the sayd Major
41. Chamberlaine, and for the accompt of the Mr XXXX GUTTER
42. Anthony one Quoyle of Roapes, The premisses XXXX GUTTER
43. he deposeth because he was present in ˹the˺ Court at the
44. Barbadoes on the severall dayes the causes concerning the
45. said goods came unto triall, and when the producent was GUTTER
46. overthronw in the said suites, and condemned with XXXX GUTTER
47. of suite in the respective valews of the sayd goods
48. And further he cannot depose saving that the sayd
49. producent did accordingly make payment or satisfaction
50. for the sayd goods not delivered as aforesayd
