To the first Interrogatorie hee answereth and saith, That hee cometh to declare the<br />

said shipp and Masters mate thereof at the time of the dammage sustained as<br />
aforesaid, which happened about 10. or 11. of the Clock in the forenoone, this deponent<br />
together with the said Yaxley , and his this deponents Contests and others being above<br />
the deck of the said shipp ''Mary'' at the time aforesaid. And further cannot depose
To the second hee saith hee hath no part or share in the said shipp the ''Mary''<br />
And saith that the Mats spoyled in the said encounter were not new, but very<br />
serviceable and sufficient, and that the sailes shrowdes standing and running<br />
rigging damnified by the meanes aforesaid were a great part<br />
of them newm and the rest very strong and serviceable, but what the particular<br />
valewes of the said masts yards shrowds sailes and rigging were either before<br />
or after the damnifyeing by the meanes predeposed, this rendent saith hee cannot<br />
declare; but saith the sailes belonging to the said shipp, and damnified as is<br />
predeposed, mayu as hee beleeveth, with some expense be made indifferet serviceable<br />
againe, and saith the said sailes and such other furniture as were not quite spoyled<br />
or lost in the said encounter are and doe remaine aboard the said shipp the ''Mary''<br />

''Mary'' aged 50. yeares or thereabouts a Wittnes sworne<br />
and examined saith as followeth videlicet:-
To the first article of the said Allegation hee saith, That hee hath well knowne the<br />
shipp ''Mary'' arlate for theise 12. yeares last past or thereabouts. And saith That<br />
in the moneths of August September and October in this present yeare <u>1654.</u> and<br />
for severall yeares before and at this present the said shipp with her tackle furniture<br />
and appurtenances hath belonged, and did and doeth lawfully belong to the arlate<br />
Robert Yaxley now Master thereof, and to George Blowers and Arthur Blowers<br />
of Alborough aforesaid and Companie, who were and are the true and lawfull<br />
Owners thereof, and for such commonly accompted reputed and taken. The premisses<br />
hee knoweth having resided at Alborough aforesaid for about 26. yeares last<br />
past, and hath sailed in and served aboard the said shipp the whole sommer last<br />
