in her with his Commission, which hee knoweth having seene
the said Commission aboard the said shipp, in which hee this deponent went
the voyage wherein shee made seizure of the Madame Guardiana. And
otherwise hee cannot depose.
To the second article hee saith and deposeth that on Good friday last past
the said Isaac Woodgreene by vertue of the said Commission in the said
shipp the African upon the high and open seas neere the Ile of Scio
met with surprized and tooke a certaine ffrench vessell called the
Madame Guardiana, whereof Peter Martin a ffrench man was Captaine,
together with her lading; and after the said seizure the said Captaine
Woodgreene was necessitated to carry the said prize to Smirna, where the
said ffrench Captaine and company got ashore, and the said Woodgreene
used diligence to get and bringe some of them home for England, but could
not prevaile therein, all which hee knoweth being present and seeing
the premisses soe donne. And otherwise hee cannot depose.
To the third article and the schedule annexed nowe showed unto him
hee saith and deposeth that hee this deponent was present in the
house of Spencer Breton Esquire Consull for the English in
Smirna, and heard the said Peter Martin the ffrench Captaine aforesaid
voluntarily make confession andd acknowledge that the said shipp the
Madame Guardiana and her lading belonged to ffrench (at the time
of the seizure) subiects of the ffrench kinge, and in this deponents
presence hee the said Captaine in further testimonie thereof
subscribed the said schedule with his owne hand and naem and as nowe
appeareth thereunder; And otherwise hee cannot depose, saving the
said acknowledgement and subscription were made and donne on the
day of the date of the said schedule.

Jaspar Devenish of London Mariner, masters
mate of the said shipp the African aged 30 yeares
or thereabouts sworne and examined.
To the first article of the said allegation hee saith and deposeth that within
the time arlate the said shipp the African was set out to sea on a
warlike imployment by the arlate henry hunt, Thomas Barnardiston and
William Love to take the shipps and goods of the States of the United
Netherlands and their subiects and of the ffrench kinge and his subiects,
by vertue of a Commission by them in that behalfe obtained, and they
the said henry hunt and company constituted and sent out Isaac
Woodgreene commander of the said shipp the said voyage with that
said Commission, which this deponent hath seene aboard, and read, hee
being one of the said shipps company as aforesaid. And otherwise
hee cannot depose.
