Transcription

that John Bancks their said factor hatha dvised them that for the preservation
of the said goods, from seizure by the ffrench, hee hath furnished the
said master with a bill of lading purporting the said goods to be vound for
Nantes in ffrance, and there to be delivered to Monsieur George [?Rozee] for his accompt
And saith the said bill for ffrance is mearly colourable and made to the
end aforesaid, and that the bill nowe showed is the true and reall bill and
that the said goods are turely belonging to the said Thomas fford and this deponent
English merchants, sibiects of this Commonwealth, and were and are
truely and really bound for Topsham in this Commonwealth there
to be dischardged, And that noe ffrenchman or other person
subiect to any Prince or State in enmities with this Commonwealth
hath any share whatsoever therein.

Thomas Lynnis of Towerstreete London
Shipwright, aged 60 yeeres or thereabouts
sworne before the right worshipfull William Clerke
doctor of lawes one of the Judges of the high Court of the
Admiraltie, and examined upon certaine Interrogatories
ministred on the behalfe of the said Valentine Austin, saith
and deposeth as followeth, videlicet.

To the first and second Interrogatories hee saith and deposeth that
hee never knew the shipp the ffortune of kerrick fergus (whereof
Arthur Crowther is said to be master) either at Mevis or at [?XXXX]
But this deponent hath heard that the interrogated Valentine Austin did
at Mevis interrogated freight a halfe part of the said shipp for
London about 3 quarters of a yeare since, and laded his said halfe part with
tobaccoes, sugars and Indico's, And otherwise hee cannot depose.

To the third hee saith hee hath heard and beleeveth that the said shipp
with the said Austings goods aboard her departed from Mevis bound
for this port of London, and that in her course of proceeding [?comming]
off Scilly shee was taken by a Brest man of warr, and with
her lading carried to Port Lewis in the dominions
of the ffrench kinge, and there condemned and made prize, and
that the losse of the said Valentine Austin amounted to about
1800 li by the said seizure and confiscation. And this hee saith hee
heard of three or foure persons of the company of the said
shipp who went to said voyage and (as they said) were in her when
shee was seized, and were present when shee and her lading [?were]
confiscated, and some of them as they said sawe the said Indico's there [?seized]

To the first Interrogatorie hee answereth negatively [?saying ?hee]
was not of the company nor any wayes belonging to the said shipp
And otherwise hee cannot answer saving as aforesaid.

To the second hee cannot depose, saving as aforesaid for hee was not
in the voyage.
